It was organised by the Directorate of Human Rights of the Council of Europe in cooperation with the Ministry of Justice of Iceland, and dealt with the following four themes: freedom of association and political democracy; freedom of association and civil society; freedom of association and social democracy; freedom to form and join or not to join trade unions. Written communications were presented on the following subjects: case law of Article 11 of the European Convention on Human Rights, freedom of association and the freedom of associations, freedom of association of immigrants in Europe, freedom of association and public service and freedom of association, labour law and the needs of a democratic society. About one hundred personalities took part: representatives of governments of member States, representatives of non-governmental organisations, members of the European Commission and Court of Human Rights, professors and other interested persons from Central, Western and Eastern Europe competent in the fields covered by the themes of the Seminar. This publication contains the Proceedings of the Seminar: the official speeches made at the opening ceremony, the reports and written communications, the interventions, the final report and the list of participants. Le Séminaire sur la 'Liberté d'association' a eu lieu à Reykjavik (Islande) du 26 au 28 août 1993. Il a été organisé par la Direction des Droits de l'Homme du Conseil de l'Europe en collaboration avec le Ministère de la Justice de l'Islande. Les travaux du Séminaire de Reykjavik ont été axés sur les quatre thèmes suivants: liberté d'association et démocratie politique; liberté des associations et société civile; liberté d'association et démocratie sociale; liberté de fonder avec d'autres des syndicats et de s'y affilier. Des communications écrites ont été présentées sur les questions suivantes: jurisprudence de l'Article 11 de la Convention européenne des Droits de l'Homme, liberté d'association et libertés des associations, liberté d'association des immigrés en Europe, liberté d'association et fonction publique et liberté d'association, droit du travail et les besoins d'une société démocratique. Book excerpt: In legal decisions and commentary, freedom of assembly is widely cherished as a precious human right and as indispensable for the preservation of democratic governance. But despite this rhetoric assemblies are subject to extensive regulation, such as prior restraints, and restrictions on the time, place and manner of assemblies. This comparative study examines five influential jurisdictions and reveals similarities and inconsistencies between them. It finds that freedom of assembly is often subjugated to freedom of expression in a way that disregards the expressive potential of assemblies. The shortcomings include the misconstrued content neutrality and public forum doctrines in the US, blanket bans and other restrictions based on intangible and distant harm in the UK, preventative restrictions and viewpoint discrimination in Germany, and the uncertain status of freedom of assembly and opaque judicial reasoning in France. Such inconsistencies also present challenges for the European Court of Human Rights in developing a coherent assembly doctrine. The book argues that it is time for jurisprudence to move away from a narrowly focused concept of expression, and recognise the creative and expressive value of freedom of assembly.

Book excerpt: The tension between national security and freedom of expression and information is both acute and multifaceted. Without national security, basic human rights are always at risk. On the other hand, the tendency of governing elites to confuse `the life of the nation' with their own survival has often resulted in excessive restrictions on expression and information, as well as other fundamental rights. A proper balance between secrecy and liberty requires a vigilant press and an independent judiciary. It also requires greater clarity than currently exists as to how competing rights and interests should be weighed. This book addresses that gap. Its centerpiece is a set of Principles drafted by a group of international and national law experts, many of whom contributed chapters, to guide governments, courts and international bodies in how to strike a proper balance. The Principles have been widely endorsed, among others by United Nations experts on freedom of expression and independence of judges and lawyers. Sixteen country studies - profiling, among other states, Albania, Chile, China, Egypt, France, Germany, India, Israel, Japan, Norway, South Africa, South Korea, Turkey, the United Kingdom, the United States, and the Federal Republic of Yugoslavia - explore the tremendous diversity of national security doctrines and the penal and other measures aimed at suppressing allegedly secret information and speech claimed to be subversive, separatist or otherwise dangerous. Five chapters examine the cases considered and approaches taken by the UN Human Rights Committee, three regional human rights bodies, and the European Court of Justice. A Commentary draws on the other chapters to support and elucidate the Principles, noting where they reflect an existing consensus and the points at which they attempt to elicit a more rights-protective approach.
