Pour faire ressortir les apports et les limites de ce droit, l’ouvrage prend appui sur les relations qu’il entretient, depuis l’origine, avec les droits nationaux et le droit international. Cette approche donne une vision à la fois riche et réaliste de la situation du droit du travail de l’Union, qui, en dépit d’une certaine autonomie, se développe dans un jeu d’interactions avec d’autres droits auxquels il emprunte, ou dont il se distingue, qui le complètent ou, au contraire, en limitent le déploiement. L’ouvrage commence par expliquer les remises en cause que le développement du droit de l’Union a imposé, dans la sphère des politiques sociales nationales. Le droit « du travail » de l’Union est, à cet égard, un droit qui affecte les rapports de travail, régis par les droits du travail nationaux, non un droit conçu pour protéger les travailleurs ou assurer les conditions d’une juste concurrence entre les entreprises. Cette deuxième dimension du « droit du travail de l’Union européenne » n’est pas, pour autant, négligeable. Depuis les années 1970, ce droit s’est considérablement développé, dans certains domaines autrefois seulement occupés par les droits nationaux et, dans une moindre mesure, par le droit international du travail. L’ouvrage illustre cette montée en puissance, et le rôle essentiel désormais tenu par le droit de l’Union dans certains segments du droit du travail. Il montre aussi le caractère parcellaire de ces développements, l’absence de couverture systématique des différents domaines, les manques. Pour combler les vides, il arrive que le droit international du travail, issu, notamment, de la CEDH ou des conventions de l’OIT soit invoqué. La dernière partie de l’ouvrage est consacrée au jeu de convergences, aux possibles complémentarités du droit de l’Union européenne et du droit international du travail, au sens large, pour en montrer l’importance, au-delà des aspects les plus apparents.

La gestion de la mobilité internationale des salariés constitue la seconde partie de l'ouvrage. À un moment donné ou à un autre de leur vie ou de leur carrière professionnelle, dirigeants et salariés seront conduits à se pencher sur l'une et/ou l'autre de ces dimensions qui se révèlent, dans la réalité, très complexes. C'est la raison pour laquelle les auteurs ont voulu les regrouper en un seul ouvrage et les expliquer très clairement avec de nombreuses illustrations pratiques dans le dessein de faire acquérir aux responsables d'entreprises et cadres de gestion tous les réflexes préventifs nécessaires à une maîtrise éclairée de ces deux sujets de grande actualité.

Comprehensively examining the legal effects of EU concluded treaties, this book provides a thorough analysis of this increasingly important and rapidly growing area of EU law. The EU has concluded more than 1000 treaties including recently its first human rights treaty (the UN Rights of Persons with Disability Convention). These agreements are regularly invoked in litigation in the Courts of the member states and before the EU courts in Luxembourg but their ramifications for the EU legal order and that of the member states remains underexplored. Through analysis of over 300 cases, the author finds evidence of a twin-track approach whereby the Court of Justice of the European Union (CJEU) adopts a maximalist approach to Treaty enforcement where EU agreements are invoked in challenges to member state level action whilst largely insulating EU action from meaningful review vis-à-vis agreements. The book also reveals novel findings regarding the use of EU agreements in EU level litigation including: the types and which specific EU agreements (including the types of provisions) have arisen in litigation; the nature of the proceedings (preliminary rulings or direct actions) and the number of occasions in which they have been addressed in challenges to member state or EU action and the outcomes; who has been litigating (individuals, institutions, or member states) and which domestic courts have been referring questions to the CJEU. The significance of the judicial developments in this area are situated within the context of the domestic constitutional ramifications for member state legal orders thus revealing a neglected dimension in the constitutionalization debates which traditionally emphasized the ramifications of internal EU law for the domestic constitutional order without expressly accommodating the constitutional significance of this external category of EU law nor the different challenges that this poses domestically. This volume will serve as a reference point for future work in this area and will also be of assistance to EU law practitioners dealing with EU agreements.

Dans l'ordre international, ce processus est perturbé par la présence, dans les organs intergouvernementaux, de représentants d'Etat qui sont autant d'organes des Etats membres, présence prolongée par le consentement aux actes adoptés en leur sein. Quel en est donc le sujet d'imputation : l'organisation ou ses membres ? Une théorie de l'acte doit être développée au coeur de la théorie de l'organe pour démontrer que l'organisation internationale est la personnification juridique d'une collectivité d'Etats dotée d'un système représentatif, et n'est que cela. La qualité de partie à un traité constitutif et de membre d'une organisation internationale ne prive l'Etat d'aucun des attributs de la souveraineté dans l'ordre international. Au contraire, la faculté d'investir un sujet de droit de compétences nouvelles est précisément un attribut de la souveraineté : l'organisation est tout entière une création des Etats membres. Leur souveraineté n'inhibe pas le processus de personnification de l'organisation qui, en retour, ne la confisque pas : la souveraineté et la relativité des rapports juridiques demeurent les principes régulateurs de l'ordre international.
