Le « droit au logement » ou le « droit au travail » sont-ils des prérogatives proprement juridiques ? L’application d’une loi peut-elle être refusée au motif qu’elle serait inique ? Une règle de conduite doit-elle être généralement obéie pour prétendre au statut de norme juridique ? Il ne s’agit là que de quelques problèmes parmi bien d’autres. L’ambition du présent ouvrage est de présenter quelques-unes des théories du droit les plus importantes du XXe siècle (principalement celles de Romano, de Kelsen, de Hart, de Villey et de Lucien François) ayant tenté de cerner avec précision les contours du phénomène juridique, en s’appuyant sur le postulat, inspiré des travaux de Foucault, suivant lequel le droit peut s’analyser à la fois comme instrument de pouvoir et objet d’un certain savoir. Dans ce cadre, de nombreuses questions fondamentales (liens entre droit et justice, entre droit et état, entre droit et pouvoir, rapports du droit et de la philosophie, rôle du juge, place de la doctrine, etc.) sont abordées.

II apparait de plus en plus que la OU se developpe Ie commerce international, l'arbitrage suit. Pour la solution des conflits commerciaux internationaux l'arbitrage s'avere dans beau coup de cas comme la voie la plus indiquee.
