Ces dernières années ont été marquées par le développement rapide des échanges commerciaux internationaux et des flux d'investissements étrangers directs. Cette expansion a favorisé la libéralisation des législations nationales dans ces deux domaines et la prolifération des accords bilatéraux, régionaux ainsi que l'ouverture des travaux au sein de l'Organisation de coopération et de développement économiques et de l'Organisation mondiale du commerce en vue de l'adoption des règles multilatérales applicables à l'investissement étranger direct. Certes une réglementation existe en matière de commerce international et d'investissement étranger direct, mais elle est encore fragmentaire. A l'avenir, cette réglementation est appelée à se renforcer au terme d'une négociation multilatérale. Dès lors, l'élaboration sous l'égide de l'Organisation mondiale du commerce de nouvelles règles touchant à la fois l'investissement étranger direct et le commerce international semble être une alternative crédible. Ces règles uniformes à vocation universelle devraient être dotées d'une force juridique obligatoire pour mieux répondre à l'internationalisation des entreprises et à l'interdépendance des économies. Une telle action au plan multilatéral garantit un ancrage solide des liens entre le commerce international et l'investissement étranger direct dans la sphère juridique. Il s'agit en effet d'établir un cadre juridique multilatéral comportant des normes élevées pour la libéralisation et la protection des investissements internationaux, avec un système efficace de règlement des différends.

This collection comprises 20 national reports from jurisdictions in Europe, North America, Latin America and Asia, addressing the private international law aspects of corporate social responsibility. They provide an overview of the legal differences between geographical areas, and offer numerous examples of how states and their courts have resolved disputes involving private international law elements.
