The GMC is formally accountable to the Privy Council but "In the absence of a mechanism which makes this accountability effective" the MPs intend to exercise this function themselves on behalf of Parliament. Revalidation of doctors has been under discussion for over 10 years. This is considered too long the GMC is expected to ensure that there are no further delays and that the current target date of late 2012 is achieved. Reviewing the GMC's current proposals MPs warn that too little attention has been given to the issue of how to deal with doctors whose practice gives cause for concern. The Committee is also concerned that the use of the word 'remediation' may have the effect of pre-judging the appropriate response to a particular set of circumstances. In relation to appraisal systems, MPs broadly support the proposal that revalidation should be based on the conclusions of employers' appraisal systems. However, there is evidence showing that the record of employers on appraisal is patchy and the importance of patient and colleague involvement in the appraisal process is emphasised. MPs also felt there should be clear guidance about how Responsible Officers should act when a conflict of interest arises between their responsibility to their employer and their responsibility to the GMC. Finally the issue of doctors for whom English is a second language was considered. As the body responsible for revalidation and with a commitment to introducing it by late 2012, the GMC is expected to satisfy itself that it has the necessary powers to fulfil this role; if it is not satisfied it needs to say so publicly and report to Parliament what changes are necessary to allow it to fulfil its function effectively

Countries across Europe understand what they are or what they should include differently. This study describes the experiences of nine countries detailing the ways they have opted to organize and finance public health services and train and employ their public health workforce. It covers England France Germany Italy the Netherlands Slovenia Sweden Poland and the Republic of Moldova and aims to give insights into current practice that will support decision-makers in their efforts to strengthen public health capacities and services. Each country chapter captures the historical background of public health services and the context in which they operate; sets out the main organizational structures; assesses the sources of public health financing and how it is allocated; explains the training and employment of the public health workforce; and analyses existing frameworks for quality and performance assessment. The study reveals a wide range of experience and variation across Europe and clearly illustrates two fundamentally different approaches to public health services: integration with curative health services (as in Slovenia or Sweden) or organization and provision through a separate parallel structure (Republic of Moldova). The case studies explore the context that explain this divergence and its implications. This study is the result of close collaboration between the European Observatory on Health Systems and Policies and the WHO Regional Office for Europe Division of Health Systems and Public Health. It accompanies two other Observatory publications Organization and financing of public health services in Europe and The role of public health organizations in addressing public health problems in Europe: the case of obesity alcohol and antimicrobial resistance (both forthcoming).

This white paper outlines the Government's proposals to protect the population from serious health threats; help people live longer, healthier and more fulfilling lives; and improve the health of the poorest. It aims to empower individuals to make healthy choices and give communities and local government the freedom, responsibility and funding to innovate and develop ways of improving public health in their area. The paper responds to Sir Michael Marmot's strategic review of health inequalities in England post 2010 - "Fair society, healthy lives" (available at http://www.marmotreview.org/AssetLibrary/pdfs/Reports/FairSocietyHealthyLives.pdf) and adopts its life course framework for tackling the wider social determinants of health. The paper gives a timetable showing how the proposals will be implemented and an annex sets out a vision of the role of the Director of Public Health. Book excerpt: The 2008 Act falls into five main parts, whose main objectives were: to establish the Care Quality Commission; to change arrangements for regulation of health professionals and of the health and social care workforce; to update the Public Health (Control of Disease) Act 1984; to create the Health in Pregnancy Grant; and to make miscellaneous other changes in relation to health and social care. Most of the provisions of the Act are now in force (in some cases with amendments made by later legislation). The main exceptions include part 2 sections 124-126, which dealt with various matters in the remit of the General Social Care Council, and were not commenced. Instead, the Council was abolished, and its functions were transferred to the Health and Care Professions Council, in 2012. Part 3 provisions relating to port health have not yet been commenced, but the intention is that they will come into force at the same time as new port health regulations. The Act achieved its objectives (or in the case of port health, is in the process of doing so), with the exception of the creation of the Office of the Health Professions Adjudicator. The rest of the memorandum considers each Part of the Act in more detail, with information about: secondary legislation made under the powers created by the Act, and key guidance issued in relation to it; any legal issues that have arisen in relation to the Act, and other reviews of the Act, that the Department of Health is aware of

Book excerpt: Drug overdose, driven largely by overdose related to the use of opioids, is now the leading cause of unintentional injury death in the United States. The ongoing opioid crisis lies at the intersection of two public health challenges: reducing the burden of suffering from pain and containing the rising toll of the harms that can arise from the use of opioid medications. Chronic pain and opioid use disorder both represent complex human conditions affecting millions of Americans and causing untold disability and loss of function. In the context of the growing opioid problem, the U.S. Food and Drug Administration (FDA) launched an Opioids Action Plan in early 2016. As part of this plan, the FDA asked the National Academies of Sciences, Engineering, and Medicine to convene a committee to update the state of the science on pain research, care, and education and to identify actions the FDA and others can take to respond to the opioid epidemic, with a particular focus on informing FDA's development of a formal method for incorporating individual and societal considerations into its risk-benefit framework for opioid approval and monitoring.

The GMC and the NMC must give a strong lead in this area and ensure that failure to act on this responsibility is regarded as a serious breach of professional obligation. The Committee stresses that both regulators need to have effective revalidation processes in place so that they can periodically check on how doctors and nurses are performing. Whilst the GMC is recognised as a high performing medical regulator, the report calls for: greater transparency in the process for doctors seeking to remove themselves from the medical register; stronger performance management of 'fitness to practice panellists' involved in adjudication of complaints; a clear right of appeal for the GMC so that it can challenge adjudication panel decisions it feels are unduly lenient. Government and both regulators must speed up efforts to resolve the serious problems posed by doctors and nurses who qualify elsewhere in Europe, and earn the right to work in the UK without having their language or medical skills tested. The UK and European law that underpins the workings of both regulators needs a complete overhaul.

Book excerpt: The Future of Nursing explores how nurses' roles, responsibilities, and education should change significantly to meet the increased demand for care that will be created by health care reform and to advance improvements in America's increasingly complex health system. At more than 3 million in number, nurses make up the single largest segment of the health care work force. They also spend the greatest amount of time in delivering patient care as a profession. Nurses therefore have valuable insights and unique abilities to contribute as partners with other health care professionals in improving the quality and safety of care as envisioned in the Affordable Care Act (ACA) enacted this year. Nurses should be fully engaged with other health professionals and assume leadership roles in redesigning care in the United States. To ensure its members are well-prepared, the profession should institute residency training for nurses, increase the percentage of nurses who attain a bachelor's degree to 80 percent by 2020, and double the number who pursue doctorates. Furthermore, regulatory and institutional obstacles-including limits on nurses' scope of practice-should be removed so that the health system can reap the full benefit of nurses' training, skills, and knowledge in patient care. In this book, the Institute of Medicine makes recommendations for an action-oriented blueprint for the future of nursing.

(1) Each facility or part of a facility constructed by, on behalf of, or for the use of a public entity shall be designed and constructed in such manner that the facility or part of the facility is readily accessible to and usable by individuals with disabilities, if the construction was commenced after January 26, 1992. (2) Exception for structural impracticability. (i) Full compliance with the requirements of this section is not required where a public entity can demonstrate that it is structurally impracticable to meet the requirements. Full compliance will be considered structurally impracticable only in those rare circumstances when the unique characteristics of terrain prevent the incorporation of accessibility features. (ii) If full compliance with this section would be structurally impracticable, compliance with this section is required to the extent that it is not structurally impracticable. In that case, any portion of the facility that can be made accessible shall be made accessible to the extent that it is not structurally impracticable. (iii) If providing accessibility in conformance with this section to individuals with certain disabilities (e.g., those who use wheelchairs) would be structurally impracticable, accessibility shall nonetheless be ensured to persons with other types of disabilities, (e.g., those who use crutches or who have sight, hearing, or mental impairments) in accordance with this section.
