Book excerpt: Around 80% of online gambling in the UK is conducted with operators which are not licensed here. In December 2012 the Government published a very short draft Gambling (Licensing and Advertising) Bill to require overseas gambling operators to obtain a Gambling Commission licence. The overseas-based remote gambling operators generally opposed the Bill, on the grounds it was unnecessary for consumer protection, might drive consumers to cheaper unlicensed operators and was principally intended to bring overseas operators within the UK's tax regime. Much of the UK-based gambling industry, sports bodies and organisations working to combat problem gambling supported the principle of the Bill. Almost all those who gave oral or written evidence to the Committee raised the issue that the enforcement regime would have to be rigorous in order to provide any of the benefits to consumers. The Committee supports the principle that gambling should be regulated on a ’point of consumption' basis. The Committee also notes the concerns raised about taxation of the online industry. The Government stated that the ability to bring all operators serving UK consumers within the tax net is a consequence, but not the prime motivation, of the draft legislation. The Committee notes in this regard that, in setting a tax rate for remote gambling, the Treasury should bear in mind that too high a rate would be liable to drive customers and companies into the unregulated, black market.

Book excerpt: This report comments in detail on the draft Gambling Bill which was published in November 2003 as Cm 6014-I (ISBN 0101601425). It is essential that the Gambling Commission has adequate resources to carry out its diverse functions. Spread betting should be subject to regular review every five years or so. Despite its deficiencies, the National Lottery Commission should carry on as the regulator for the National Lottery after the Gambling Commission is set up. The costs of regulation should be borne by those that are regulated and fee levels should be subject to consultation. Premises licensing should ultimately be a matter for licensing authorities, subject to adequate financing, and training. Local authorities should retain the power to prevent proliferation of gambling premises. The research carried out by the Responsibility in Gambling Trust on problem gambling, is commended, and voluntary contributions from the industry to the Trust should be encouraged. Machine gambling by under-18s - and gambling advertisements - should remain under review. The Committee agrees with the proposed 3:1 gaming machine to table ratio in small casinos, but a greater ratio should be considered for larger resort casinos (which should also be required to provide additional leisure and cultural facilities).

The draft Gambling Bill was published in November 2003 as Cm 6014-I (ISBN 0101601425). 121 of the Committee's 139 conclusions and recommendations are accepted by the Government, for example, no casino should be permitted an unlimited number of gaming machines, and gaming machines will be removed from unlicensed premises such as fish and chip shops and mini-cab offices. The Government accepts that new opportunities for gambling should be introduced cautiously. It does not accept that the consequent increase in gambling provision will lead to an increase in the number of people with a gambling problem. Several new proposals are outlined in this 2004 response, for example, every operator will be required to comply with the Gambling Commission codes of practice on social responsibility; only large regional casinos will be permitted to install unlimited prize gaming machines; and small casinos will be permitted only a maximum of 80 machines, large casinos, 150 machines, and regional casinos, 1250 machines.

This examination is carried out in the light of the Rippon Commission report on the topic (Making the Law produced by the Hansard Society Commission on the Legislative Process) which was published in 1992. Topics discussed include the mechanisms for pre-legislative and post-legislative scrutiny, the growth of legislation, the dissemination of information and ways of gauging public opinion through consultation. Conclusions drawn by the Committee include concern over the growth in the number and complexity of bills being presented to Parliament without adequate expansion in the capacity to deliver effective scrutiny. The report contains a number of proposals designed to help engender a culture shift away from this unsustainable volume of legislation, towards a culture of justification which encourages government to adopt a more disciplined approach to the introduction of bills based on the objective of effectiveness rather than quantity.
