The Committee's report (HCP 876-I, ISBN 0104130024) was generally supportive of the broad purposes of the draft Bill, but made 148 recommendations under the broad headings of: the framework for the new regulator, OFCOM; economic regulation; media ownership; content regulation. The media ownership elements had attracted much advance attention, and the Committee recommended that restrictions on non-European Economic Area ownership of broadcasting licences should not take place until after a review by OFCOM.

Book excerpt: The Bill will give effect to the Government's proposals for the reform of the regulatory framework for the communications sector (as set out in the White Paper - "A New Future for Communications"; Cm 5010). The main provisions are: the transfer of regulatory functions to a new body, the Office of Communications (OFCOM); the replacement of the current system of licensing telecommunications systems; the power to develop a new mechanism to enable spectrum to be traded; the development of the current system for regulating broadcasting - both to rationalise the regulation of public service broadcasters and accommodate the switchover to digital broadcasting; the establishment of a consumer panel to advise OFCOM; the establishment of a content board to advise OFCOM in relation to the content of anything broadcast. In February 2002 the European Parliament and the Council of Ministers adopted four directives on a common regulatory framework for electronic communications. Provisions in this Bill implement these regulations in the UK.

Whilst calling for a narrower focus, the Committee recognises that more needs to be done to provide law enforcement and other agencies access to data they cannot currently obtain and so makes a range of constructive proposals to enable the Home Office to present a better Bill to Parliament. There must also be much better consultation with industry, technical experts, civil liberties groups, public authorities and law enforcement bodies before a new Bill is introduced.
