Book excerpt: The pervasiveness of domestic violence in the United States during the 1960s and 1970s prompted policy makers to implement mandatory arrest laws to provide additional protection to victims and to inform offenders of consequences. However, since mandatory arrest policies have been put into practice, much discord over their effectiveness and use has ensued. This project report offers a historical tracing and explores various factors indicated in the literature related to the role of law enforcement and mandatory arrest policies in terms of their impact on domestic violence. Despite the efforts by lawmakers and women's rights activists across the nation to improve the detriment of intimate partner violence, no single solution was identified in the literature to stop the epidemic. As incidents of intimate partner violence continue to occur each day, the literature demonstrates the need for continued evaluation of current procedures and development of new policies.

Overall, California legislation pertinent to domestic violence addresses it as a serious crime and assures victims the maximum protection from abuse that the law and those who enforce it can provide. The guidelines presented are under the topical categories of enforcement of laws, felony arrest, misdemeanor arrest, private person's arrest, reporting, restraining/protective orders, tenancy, victim assistance, seizure of firearms, and officer safety. The training curriculum consists of the following topics and hours of instruction for each topic: overview of domestic violence, 1.5 hours; legislative intent/POST guidelines, 1.0 hour; enforcement of laws, 1.5 hours; court orders, 1.0 hour; tenancy, 0.5 hours; documenting domestic violence incidents, 0.5 hours; victim assistance and referral, 0.5 hours; and practical application/student evaluation, 1.5 hours. A total of 8 hours is required for instruction. A 21- item bibliography and the texts of relevant California law.

Sherman, a leading police researcher, is the architect of the 1984 Minneapolis Domestic Violence Experiment - the first controlled test of the effects of arrest on repeat crime. The results are both surprising and provocative." "In fact, arrest deters selectively. Sherman found that it effectively inhibits some offenders, but incites more violence in others. It may also deter batterers for a month or so, only to make them more violent later on. Under this policy, therefore, some women exchange short-term safety for a longer-term increase in danger. Sherman also shows that compulsory arrest reduces violence against middle-class women at the expense of those (often black) who are poor. Some advocates of the policy have endorsed this moral choice, but Sherman argues that domestic violence will continue in spite of, and sometimes because of, our attempts to stop it. Further, while it is possible to predict which couples will continue to suffer abusive behavior, it has been difficult to find effective ways of preventing chronic violence, even when arrests are made.
