The Nuclear Waste Policy Act of 1982 directs the Dept. of Energy (DoE) to dispose of this waste in a repository at Yucca Mountain, Nevada. In June 2008, DoE submitted a license application for the repository, but in March 2010 moved to withdraw it. However, the NRC or the courts could compel DoE to resume the licensing process. This report examines: (1) the basis for DoE's decision to terminate the Yucca Mountain program; (2) the termination steps DoE has taken and their effects; (3) the major impacts if the repository were terminated; and (4) the principal lessons learned. Book excerpt: The Department of Energy's Office of Environmental Management (EM) directs the massive cleanup of more than 100 sites that were involved in the production of nuclear weapons materials during the Manhattan Project and the Cold War. This report offers suggestions for more effectively characterizing and treating the orphan and special-case wastes that are part of EM's accelerated cleanup program. It identifies technical opportunities for EM to improve the program that will save time and money without compromising health and safety. The opportunities identified include: making more effective use of existing facilities and capabilities for waste characterization, treatment, or disposal; eliminating self-imposed requirements that have no clear technical or safety basis; and investing in new technologies to improve existing treatment and characterization capabilities. For example, the report suggests that EM work with DOE classification officers to declassify, to the extent possible, classified materials declared as wastes. The report also suggests a new approach for treating the wastes that EM will leave in place after cleanup.

Book excerpt: In 1998, the U.S. Department of Energy (DoE) plans to begin a $19 billion program to dispose of 176,000 c.m. of transuranic waste that will be permanently stored in the Waste Isolation Pilot Plant (WIPP), a repository near Carlsbad, NM. However, DoE must first obtain from EPA a certificate of compliance with its disposal regulations for radioactive waste and meet the requirements of RCRA for handling and disposing of hazardous waste. This report assesses the prospects for opening WIPP and determines how well DoE is positioned to begin filling it in the first few years of operation and longer.

Book excerpt: Recognizing the critical need to address the issue of nuclear waste disposal, the Congress enacted the Nuclear Waste Policy Act of 1982 to establish a comprehensive policy and program for the safe, permanent disposal of commercial spent fuel and other highly radioactive wastes in one or more mined geologic repositories. In the act, the Congress stated that federal efforts to devise a permanent solution for disposing of radioactive waste had been inadequate. The act charged DOE with (1) establishing criteria for the recommendation of sites for repositories; (2) "characterizing" (investigating) three sites to determine each site's suitability for a repository; (3) recommending one suitable site to the President who, if he considers the site is qualified for a license application, submits a recommendation of such site to the Congress; and (4) upon approval of a recommended site, seeking a license from NRC to construct and operate a repository at the approved site. The act created the Office of Civilian Radioactive Waste Management within DOE to manage its nuclear waste program. When the act was passed, it was expected that a repository could be operational in 1998. Amendments to the act in 1987 directed DOE to investigate only the Yucca Mountain site. These amendments also established the Nuclear Waste Technical Review Board (the Board). The Board's decision is to review the technical and scientific validity of DOE's activities associated with investigating the site and packaging and transporting wastes, and to report its findings and recommendations to the Congress and DOE at least twice each year. The act does not require DOE to implement the Board's recommendations.
