It is now ten years since the discontinuance of the State tax. The General Fund then accumulated, with an inconsiderable in come from other sources, besides paying two hundred and ninety four thousand one hundred and eleven dollars and sixty-nine cents for the support of the lateral canals, and many large appropria tions for other objects, has sustained the ordinary expenses of the government far beyond the period anticipated when the State tax was discontinued. This fund is now not only exhausted, but the State at the end of the last fiscal year, was in debt to other funds for the current expenses of the treasury, four hundred and six thou sand and sixty-eight dollars and ninety-seven cents. I do not find in the amendment any such meaning or effect. I do not consider that the amendment in any degree whatever will enlarge the taxing power of the National Government or will have auv effect except to relieve the exercise of that taxing power from the requirement that the tax shall be apportioned among the several states. The died of the amendment will be, in mv view, the same as if it said, The United States may lay a tax on incomes without apportioning the tax, and this shall be applicable whatever the source of the income subjected to the tax, leaving the question, What incomes are subject to National taxation? To be determined by the same principles and rules which are now applicable to the determination of that question.
