Book excerpt: In recent years there has been an increased realization that the casual disposal of wastes can lead to a deterioration in environmen tal quality with substantial impacts on society. The management of waste disposal practices must consider the various alternatives of discharging and decomposing wastes on land, in the atmosphere, and in the marine environment. Up until 1972 ocean dumping was used increasingly to dispose of sewage sludge, industrial wastes, and dredged material. In subsequent years regulations were developed to reduce and minimize ocean dumping. These regulations were prompted often by ignorance of the possible effects of waste disposal in the ocean rather than by knowledge that such ocean dumping was detrimen tal to the marine environment or to man. The relationship between waste disposal and the oceans can be viewed in either of two ways. One may want to assure that waste disposal procedures do not alter adversely the marine environment, or one may choose to utilize the ocean as a waste depository to reduce the burden placed on the con tinental ecosystem and on the atmosphere. From either perspective it is essential that there be an adequate base of technical information to assess the fate and effects of wastes introduced to the ocean. A series of original technical papers has been compiled in this book to present some of the recent results of research on industrial waste disposal in the ocean.

Book excerpt: Marine debris from ships and other ocean-based sources-including trash and lost fishing gear-contributes to the spoiling of beaches, fouling of surface waters and the seafloor, and harm to marine animals, among other effects. Unfortunately, international conventions and domestic laws intended to control marine debris have not been successful, in part because the laws, as written, provide little incentive to change behavior. This book identifies ways to reduce waste, improve waste disposal at ports, and strengthen the regulatory framework toward a goal of zero waste discharge into the marine environment. Progress will depend on a commitment to sustained funding and appropriate institutional support. The Interagency Marine Debris Coordinating Committee should, through planning and prioritization, target research to understand the sources, fates, and impacts of marine debris. It should support the establishment of scalable and statistically rigorous protocols that allow monitoring at a variety of temporal and spatial scales. These protocols should contain evaluative metrics that allow assessment of progress in marine debris mitigation. The United States, through leadership in the international arena, should provide technical assistance and support for the establishment of additional monitoring and research programs worldwide.

An effective solution depends upon the cooperation of all states towards achieving agreed objectives. This book provides a critical assessment of the role that international law plays in this process, by explaining and evaluating the various legal instruments that have been negotiated in this area, as well as key trends in global ocean governance. Starting with a detailed analysis of the United Nations Convention on the Law of the Sea, the book considers the main treaties and other legal texts that seeks to prevent, reduce, and control damage to the marine environment caused by navigation, seabed exploitation, fishing, dumping, and land-based activities, as well as emerging pressures such as ocean noise and climate change. The book demonstrates how international institutions have expanded their mandates to address a broader range of marine environmental issues, beyond basic problems of pollution control to include the conservation of marine biological diversity and an ecosystems approach to regulation. It also discusses the development of diverse regulatory tools to address anthropogenic impacts on the marine environment and the extent to which states have adopted a precautionary approach in different maritime sectors.
