Download or read book Dictatorship Democracy and Transitional Justice in Global Legal History written by Ignacio Czeguhn and published by Duncker & Humblot. This book was released on 2023-12-19 with total page 214 pages. Available in PDF, EPUB and Kindle. Book excerpt: The anthology presents the lectures given on the symposium »From Dictatorship to democracy« at the House of the Wannsee Conference on 13–14 September 2021. The aim of the organizers was to show what problems existed during the transition from dictatorship to democracy in several countries around the world. They all enacted laws or other measures to ensure that fundamental rights and the rule of law would resist anti-democratic ideologies, anti-Semitism, racism, and war crimes in the future. However, the legal system and law in these countries themselves often had their origins in dictatorship. Thus, there were and are obvious and hidden anti-democratic continuities that influence law and the legal system up to the present. Scientifics and jurists from Italy, Japan, Poland, Spain, South Africa, and Germany examine these continuities in their contributions.
Download or read book Labour Law between Change and Tradition written by Roger Blanpain and published by Kluwer Law International B.V.. This book was released on 2011-05-11 with total page 319 pages. Available in PDF, EPUB and Kindle. Book excerpt: On the occasion of the official ‘retirement’ of the eminent labour law scholar Antoine Jacobs, a number of his colleagues – themselves well-respected in the field of labour law and industrial relations – have assembled this volume of essays to manifest the breadth and variety of this great professor’s work. The authors pay particular attention to the tension, always present in Jacobs’s critical research, of traditional values with an acute awareness of emerging realities. He approached labour law, not merely as a series of static issues concerning workers and employers, but as an evolving discipline that persistently challenged its socio-political context. Among the wide range of issues considered in this collection – all of them prominent in Jacobs’s work – are the following: the right to work; the right to strike versus the freedom to strike; the role of the European Union in national labour law; transnational collective bargaining; social security issues; labour law and the social teaching of churches; bankruptcy; and more.

Download or read book Corporatism and Fascism written by Antonio Costa Pinto and published by Taylor & Francis. This book was released on 2017-02-17 with total page 327 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is the first conceptual and comparative empirical work on the relation between corporatism and dictatorships, bringing both fields under a joint conceptual umbrella. It operationalizes the concepts of social and political corporatism, diffusion and critical junctures and their particular application to the study of Fascist-Era dictatorships. The book’s carefully constructed balance between theory and case studies offers an important contribution to the study of dictatorships and corporatism. Through the development of specific indicators in ‘critical junctures’ of regime change and institutionalization, as well as qualitative data based on different sources such as party manifestos, constitutions and constitutional reforms, expert commissions and the legislation that introduces corporatism, this book traces transnational sources of inspiration in different national contexts. By bringing together a number of both established and new voices from across the field, this book will be of interest to students and scholars of fascism, dictatorship and modern European politics.

This book was released on 2014-07-14 with total page 446 pages. Available in PDF, EPUB and Kindle. Book excerpt: Political scientists generally have been disposed to treat Italian Fascism--if not generic fascism--as an idiosyncratic episode in the special history of Europe. James Gregor contends, to the contrary, that Italian Fascism has much in common with an inclusive class of developmental revolutionary regimes. Originally published in 1980. Download or read book Socialism of Fools written by Michele Battini and published by Columbia University Press. This book was released on 2016-04-05 with total page 424 pages. Available in PDF, EPUB and Kindle. Book excerpt: In Socialism of Fools, Michele Battini focuses on the critical moment during the Enlightenment in which anti-Jewish stereotypes morphed into a sophisticated, modern social anti-Semitism. He recovers the potent anti-Jewish, anticapitalist propaganda that cemented the idea of a Jewish conspiracy in the European mind and connects it to the atrocities that characterized the Jewish experience in the nineteenth and twentieth centuries. Beginning in the eighteenth century, counter-Enlightenment intellectuals and intransigent Catholic writers singled out Jews for conspiring to exploit self-sustaining markets and the liberal state. These ideas spread among socialist and labor movements in the nineteenth century and intensified during the Long Depression of the 1870s. Anti-Jewish anticapitalism then migrated to the Habsburg Empire with the Christian Social Party; to Germany with the Anti-Semitic Leagues; to France with the nationalist movements; and to Italy, where Revolutionary Syndicalists made anti-Jewish anticapitalism the basis of an alliance with the nationalists. Exemplified best in the Protocols of the Elders of Zion, the infamous document that "leaked" Jewish plans to conquer the world, the Jewish-conspiracy myth inverts reality and creates a perverse relationship to historical and judicial truth. Isolating the intellectual roots of this phenomenon and its contemporary resonances, Battini shows us why, so many decades after the Holocaust, Jewish people continue to be a powerful political target.

Examining corporate compliance as a tool of criminal and regulatory policy strategies in different countries and sectors, this book also aims to provide a picture of the dimension and scope of the public-private partnership, focusing on the prevention and detection of corporate crimes. It analyzes the effects of corporate compliance on the internal organization in terms of cost-benefit assessment, as well as the opportunities in technical innovation for detecting and controlling risk.
