Book excerpt: Diante dos avanços tecnológicos, do prolongamento da vida humana, mediante as descobertas científicas e aprimoramento da medicina, especialmente no último século, tem-se uma demanda populacional que explora, de maneira desorientada e sem medidas, os recursos naturais. Em razão disso, as questões relacionadas aos ecossistemas e meio ambiente, sua preservação e proteção tornam-se um grande desafio para a humanidade. Em diferentes pontos do globo, iniciam-se movimentos de conscientização acerca da relevância do meio ambiente e a necessária regulação de seu uso, a partir do desenvolvimento de princípios que, ao longo das décadas, tornaram-se princípios fundamentais e norteadores da sociedade contemporânea, a exemplo do princípio da sustentabilidade. Juntamente com a evolução do Direito Ambiental, tem-se a transformação de paradigmas e novos desafios se apresentam, como a transformação do próprio conceito de sustentabilidade e sua aplicação transnacional e interdisciplinar. Diante da finitude dos recursos naturais, mais do que um princípio legal, a sustentabilidade torna-se um princípio de caráter fundamental, tamanha sua importância e nível de moralidade que deverá estar presente em ações protetivas e restaurativas dos ecossistemas. A gestão dos recursos naturais torna-se uma fonte de tensão entre várias categorias de atores, cujo processo de tomada de decisão e participação social encontra obstáculos e mostra-se frágil em um panorama de proteção ainda extremamente generalizado, o que torna pouco eficientes as ações fáticas e normativas estatais, conferidas aos indivíduos pelos direitos fundamentais, as quais deveriam lhes assegurar as liberdades e a dignidade humana. O ordenamento jurídico brasileiro confere, portanto, um novo tratamento às demandas ambientais a partir da Constituição de 1988, recebendo-se o direito ambiental como um direito universal e fundamental, cuja proteção constitucional advém do reconhecimento do bem ambiental como um direito humano pertencente a toda a coletividade e, assim, integrando a categoria dos direitos humanos de terceira dimensão, devido ao seu caráter difuso. Inserido neste contexto de integração da proteção ambiental ao ordenamento jurídico pátrio é que se esculpe a obra “Direito Ambiental Constitucional: Desafios e Perspectivas”, na qual se buscou reunir problemáticas, cujos núcleos encontram-se no cuore da proteção ambiental no Brasil, a partir de sua constitucionalização, expandindo-se para as diferentes áreas do direito, o que demonstra a dinâmica, a multidisciplinaridade e a relevância do tema.

Em um momento em que se busca a “simplificação” do Direito Ambiental e que surgem tantos especialistas na área, a reflexão crítica se faz necessária. Este “novo” ramo do Direito, que se consolidou como autônomo e independente, não pode ser analisado de forma isolada. Há normas constitucionais, administrativas, processuais, dentre tantas outras, que estão inseridas no contexto do Direito Ambiental. Cuida-se de um direito prospectivo que tem por condão moldar comportamentos respeitosos para com o ambiente e que, em essência é democrático, tendo em vista a estrutura normativa e princípio lógica que lhe dão sustentação. Direito complexo e, portanto, avesso às análises solitárias, rasas e banais. Não há qualquer possibilidade de se examinar o Direito Ambiental, sem a observância de tais aspectos. E não é por acaso que os principais setores da economia mundial incorporam a proteção ambiental em seus modelos de negócio, em conjunto com outras áreas, de forma a abranger os aspectos sociais, econômicos e de governança, todos elementos inafastáveis das questões ambientais que, cada vez mais, se afirmam como urgentes. Ainda que a tecnologia - com vídeos e redes sociais - nos facilitem a comunicação com os operadores da área, precisamos de referenciais teóricos qualificados. E com mais uma publicação, esta sobre os desafios e perspectivas da advocacia ambiental, a UBAA pretende preencher este espaço. Vivemos uma crise ambiental sem precedentes, na qual o atual momento brasileiro é particularmente preocupante e precisamos estar atentos em defesa da construção coletiva do Direito Ambiental Brasileiro que, ao longo de 40 anos, tem sido um dos instrumentos de afirmação de nossa vocação para potência ambiental de nível internacional. A advocacia ambiental vive determinados paradoxos que muitas vezes levam o profissional a não entender o seu papel, aplicando a lei ambiental de forma equivocada, não poucas vezes fruto de um positivismo limitante e ultrapassado. A capacidade de compreender a complexidade multifacetada das questões ambientais e incorporá-las à prática diária da advocacia ambiental é o grande desafio diante de todos nós advogados. A UBAA, espera, mais uma vez, colaborar para a construção de um Direito Ambiental democrático e, portanto, capaz de forjar um entendimento moderno do Direito Ambiental Brasileiro, tornando-o apto a colaborar na proteção de nosso patrimônio ambiental e no desenvolvimento sustentável do país, com respeito ao meio ambiente, comunidades tradicionais, povos indígenas e liberdades públicas. Como se sabe, a advocacia só floresce em regimes democráticos.

Book excerpt: It is clear that international law is not yet equipped to handle the “ecological goods and services” that exist simultaneously within and outside of all states. The global commons have always been understood as geographical spaces that exist only outside the political borders of states. A vital good such as a stable climate exists both within and outside all states, and shows traditional legal approaches to be ecological nonsense. With the recent possibility of measuring and monitoring the state and functioning of the Earth System through the Planetary Boundaries framework, it is now possible to define a “Safe Operating Space of Humankind” corresponding to a biogeophysical state of Earth. In this sense, the Common Home of Humanity is not a planet with 510 million square kilometres, but is a specific favourable state of the Earth System. Recent major scientific advances anticipate a legal paradigm shift that could overcome the disconnection between ecological realities and existing legal frameworks. If we recognize this qualitative and non-geographic space as a Common Natural Intangible Heritage of Humankind, all positive and negative “externalities” end up being included within a new maintenance system of the Common Home.
