Bringing together legal scholars from the Global South and the Global North, it examines these questions in the context of national, transnational and international law, within single and plural legal systems, and across a range of sector-specific issue areas. The chapters identify how traditional legal disciplines (e.g. constitutional law, consumer law, public procurement, international public law), sector-related regulation (e.g. energy, water, waste), and legal rules in specific areas (e.g. eco-labelling and packing) engage with the concept of sustainable consumption. A number of the contributions describe this relationship by isolating a national legal system, while others approach it from the vantage point of legal pluralism, exploring the conflicts and convergences of rules between multiple international treaties (or guidelines) and those between the rules of international and transnational law (or both) vis-à-vis national legal systems. While sustainable consumption is recognised as an important field of interdisciplinary research linking virtually all social science disciplines, legal scholarship, in contrast, has neglected the importance of the field of sustainable consumption to the law. Plataformas de intermediação, economia de compartilhamento, proteção de dados, aprimoramento do e-commerce, foram alguns dos temas que precisaram ser aprofundados e enfrentados pelos operadores do Direito, de modo a apresentar à sociedade de consumo diretrizes para o seu efetivo funcionamento. Do ponto de vista processual, novos temas também começaram a ocupar espaço no dia a dia. A sobrecarga do Poder Judiciário justificou o estudo aprofundado de on line dispute resolutions, como forma alternativa de soluções de conflitos. Os danos coletivos, em casos de violação a direitos individuais homogêneos, também passaram por reflexões perante o Superior Tribunal de Justiça. Assim, com o objetivo principal de agregar tecnicamente aos principais e atuais temas que circundam as relações de consumo em nosso país, nosso grupo entrega mais esse trabalho coletivo que, acima de qualquer coisa, é motivo de orgulho e satisfação.

Transgenic food is suspected to cause bodily harm, have a negative impact upon the health of animals, weaken the productivity of conventional farmland, reduce biodiversity or otherwise deteriorate the environment, to name but a few dangers popping up in the public debate. Apart from setting standards for GM farming and requiring safety checks for transgenic products, all jurisdictions also provide for the case that such risks should materialize. These are not necessarily novel approaches - classic tort law already offers remedies for such losses. Sometimes these traditional solutions are enhanced or replaced by alternative redress schemes. This volume compares twenty European and four non-European jurisdictions in this respect and provides special analyses from an economic and insurance perspective as well as surveys of cross-border dispute resolution and international law.

Relations between Brazil and Japan progressed dynamically in the 1960s and 1970s, centering on the substantial complementarity between Japan’s needing primary goods to sustain high economic growth and Brazil’s seeking non-hegemonic investment to invigorate its resource potential. Now that this complementarity has lost significance, the two countries are restructuring their relations to protect shared values of democracy, freedom, the rule of law, and the need for maintaining good relations with both China and the United States. Analyzed here is the development of this renewed bilateral relationship in multiple directions: productivity, global environment and health, migration, and triangular cooperation in third countries’ development. Facing the prospect of a declining population, Japan may become more open to international migration, but the experience with Japanese-descent Brazilian workers since the amendment of the migration control law in 1990 presents many lessons and challenges for the symbiosis of multicultural groups. Brazil, for its part, needs to address social inequality. To this end, it is fundamental to improve the quality of work. This book argues that Brazil and Japan can benefit from cooperation in managing those country-specific issues. It also discusses ways that Brazil and Japan can profit from coordinating action on global problems such as greenhouse gas reduction, mitigation of tropical diseases, healthy community building, and high-quality infrastructure for poverty reduction.
