Book excerpt: El presente trabajo tiene como finalidad analizar dos de las figuras que, en nuestra opinión, menos atención han recibido en el ámbito procesal pese a su raigambre histórica y su novedad legislativa absoluta, la prueba anticipada y el aseguramiento de la prueba, respectivamente. Ambas figuras han sido objeto de un mínimo enjuiciamiento jurisprudencial y estudio doctrinal, pese a ser dos piezas fundamentales para la válida consecución de la tutela jurisdiccional. En el plano jurisprudencial el análisis de ambas figuras ha arrojado luz en torno sus características y sus finalidades pero este estudio ha traído también ciertas sombras, debido sobre todo al hecho de que los tribunales confunden, en algunos casos, la anticipación y el aseguramiento con las diligencias preliminares y, con mucha frecuencia, con las medidas cautelares. Por lo que respecta al ámbito doctrinal comprobamos como existen muy pocas obras de renombrados tratadistas que hayan profundizado en el estudio de la anticipación o el aseguramiento de la prueba. No entendemos el por qué de esta falta de atención hacia estas figuras, puesto que junto con las diligencias preliminares y las medidas cautelares son la base para asegurar la debida consecución de la Justicia...

Book excerpt: Patent infringement procedures are an instrument whereby the patentee defends his protected invention against unlawful use by a third party (the alleged infringer). The difficulty is that the patent is no solid object whose damage can be easily detected; it belongs to that group of rights whose infringement is not easy to determine. The patent is a right described by words, and those words, written into a claim, are so complicated that laymen and lawyers alike fail to understand them. This is the special feature which distinguishes the patent right. This book consists of a series of country reports in which expert patent attorneys describe the patent infringement procedures in their jurisdiction.
