Book Developing Warrior Lawyers

Download or read book Developing Warrior Lawyers written by Geoffrey S. Corn and published by . This book was released on 2012 with total page 6 pages. Available in PDF, EPUB and Kindle. Book excerpt: This article critiques the current military legal education paradigm. It asserts that one lesson from the Iraq War is that there is no longer sufficient justification to disperse law of war education for military attorneys among the different service Judge Advocate General's (JAG) schools. Instead, the Department of Defense should consolidate the substantial expertise that exists throughout the military legal community into one center of excellence: a Joint Service Law of War Academy. This article asserts that such a center of excellence is essential to fully prepare military legal advisors for the demands of the modern battlefield.

Available in PDF, EPUB and Kindle. Book excerpt: Air, water, food - these are the sources of life. Without them, we die. And in most nations -- more than 180 countries, in fact - citizens are legally entitled to these essential elements of life. In some countries, Mother Nature herself has legal rights. But not in Canada or the United States. In Warrior Lawyers, courageous and dedicated lawyers from nine countries tell their own stories of trail-blazing lawsuits that have transformed nations and changed history. Impoverished Argentinians win a multi-billion-dollar cleanup of the Riachuelo River in Buenos Aires. An innovative foundation forces the Dutch government to take dramatic action on climate change. Ecuadorian natives and peasants defeat mighty Chevron in a $9.5 billion action for fouling the Amazon rain forest. The Supreme Court of the Philippines asserts the rights of future generations to a healthy, bountiful world. Behind these victories is a set of dedicated lawyers whose true client is the Earth herself. Warrior Lawyers includes 15 extended interviews with lawyers from five continents, and Silver Donald Cameron contributes a long essay discussing the importance of these lawyers and their work -- and the opportunities that environmental rights offer to both Canadians and Americans. The author of 17 previous books, Cameron is host and executive producer of the companion documentary film Green Rights: The Human Right to a Healthy World, (www.GreenRIghts.com ), in which many of the warrior lawyers also appear. This full-length film is produced and directed by Chris Beckett. Cameron and Beckett also operate the subscription web site, www.TheGreenInterview.com, where full-length original versions of these interviews are posted, along with dozens of others, in video and audio as well as text, "A powerful read for anyone who cares about our planet." Robin R. Milam, Global Alliance for the Rights of Nature "Moving, terrifying, inspirational - these stories stand as a beacon of hope in our troubled world. " Maude Barlow, The Council of Canadians "Intriguing and inspiring -- Cameron, a green warrior himself, and a great story-teller, deftly writes of legal battles won and those to come." Book Uncivil Warriors

  • Author : Peter Hoffer
  • Publisher : Oxford University Press

Download or read book Uncivil Warriors written by Peter Hoffer and published by Oxford University Press. This book was released on 2018-05-01 with total page 272 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the Civil War, the United States and the Confederate States of America engaged in combat to defend distinct legal regimes and the social order they embodied and protected. Depending on whose side's arguments one accepted, the Constitution either demanded the Union's continuance or allowed for its dissolution. After the war began, rival legal concepts of insurrection (a civil war within a nation) and belligerency (war between sovereign enemies) vied for adherents in federal and Confederate councils. In a "nation of laws," such martial legalism was not surprising. Moreover, many of the political leaders of both the North and the South were lawyers themselves, including Abraham Lincoln. These lawyers now found themselves at the center of this violent maelstrom. For these men, as for their countrymen in the years following the conflict, the sacrifices of the war gave legitimacy to new kinds of laws defining citizenship and civil rights. The eminent legal historian Peter Charles Hoffer's Uncivil Warriors focuses on these lawyers' civil war: on the legal professionals who plotted the course of the war from seats of power, the scenes of battle, and the home front. Both the North and the South had their complement of lawyers, and Hoffer provides coverage of each side's leading lawyers. In positions of leadership, they struggled to make sense of the conflict, and in the course of that struggle, began to glimpse of new world of law. It was a law that empowered as well as limited government, a law that conferred personal dignity and rights on those who, at the war's beginning, could claim neither in law. Comprehensive in coverage, Uncivil Warriors' focus on the central of lawyers and the law in America's worst conflict will transform how we think about the Civil War itself.

Available in PDF, EPUB and Kindle. Book excerpt: Who are "The Legal Warriors" in this book? Some might think these are lawyers. But that is wrong. The real Legal Warriors in this book are the poor individuals and families who daily struggle to gain their rights. The real Legal Warriors are their community groups fighting for justice and improvements in society. These fighters include families struggling to save their homes from foreclosure. They are the neighborhood organizations combatting the industrial polluters who poison our water and air. They are the soldiers who skirmish to keep their gas and lights on. They are newcomers who come to our region to seek a "fresh start in life." These are only some of the legal warriors that I have been privileged to serve in my fifty years of legal work. To all of them I say thank you for sharing your battles with me. This book is dedicated to you. I pray and hope that the Good Lord blesses you and your communities with many well-deserved legal victories in all of your struggles.

Book Law and the Epistemologies of the South

Download or read book Law and the Epistemologies of the South written by Boaventura de Sousa Santos and published by . This book was released on 2023-08-09 with total page 824 pages. Available in PDF, EPUB and Kindle. Book excerpt: Modern state law excludes populations, peoples, and social groups by making them invisible, irrelevant, or dangerous. In this book, Boaventura de Sousa Santos offers a radical critique of the law and develops an innovative paradigm of socio-legal studies which is based on the historical experience of the Global South. He traces the history of modern law as an abyssal law, or a kind of law that is theoretically invisible yet implements profound exclusions in practice. This abyssal line has been the key procedure used by modern modes of domination - capitalism, colonialism, and patriarchy - to divide people into two groups, the metropolitan and the colonial, or the fully human and the sub-human. Crucially, de Sousa Santos rejects the decadent pessimism that claims that we are living through 'the end of history'. Instead, this book offers practical, hopeful alternatives to social exclusion and modern legal domination, aiming to make post-abyssal legal utopias a reality.

Book A Legal Personality for the St Lawrence River and other Rivers of the World

Download or read book A Legal Personality for the St Lawrence River and other Rivers of the World written by Yenny Vega Cárdenas and published by Editions JFD. This book was released on 2023-03-15 with total page 544 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the wake of the recognition of the Whanganui River in New Zealand, the Ganges and Yamuna Rivers in India, the Yarra River in Australia and the Atrato River in Colombia as «subjects of rights», the International Observatory on Nature’s Rights has initiated a reflection on the possibility of recognizing the St. Lawrence River, the «path that walks» as it is called by the First Nations, as a «legal person». The texts in this collective work deal with the implications of attributing a legal personhood and rights to the St. Lawrence River, delve into the epistemological foundations of the paradigm of the recognition of the rights of Nature and present concrete cases of recognition of rivers as subjects of law. Written by experts from several countries where the recognition of the legal personhood of rivers has occurred to date, they take an in-depth look at the challenges and contributions of this paradigm shift in river protection. This book answers questions about the implications of such recognition and contributes to the process of building a new law that has just begun in Quebec and Canada with the adoption in February 2021 of resolutions conferring the status of «legal person» on the MagPie/ Muteshekau Shipu River located on the North Shore of Quebec and on the Nitassinan (ancestral territory) of two Innu communities, Ekuanitshit and Uashat mak Mani-utemam. Available in PDF, EPUB and Kindle. Book excerpt: Leadership is a mindset, not a title or position. In Fundamentals of Lawyer Leadership, we explore the aspects of leadership that law students can develop and improve during their time in law school. This textbook begins with the underpinnings of leadership, what it means, and how history guides our view of it. In Part Two – Leadership with Others: Effective Group Dynamics, the book covers topics such as building and nurturing relationships, developing emotional and cultural intelligence, establishing effective teams, and inspiring others. Finally, in Part Three – Leadership within Community: Service and Impact, the book examines the role of the lawyer in society and how you can use your skills to have influence even when you are not in charge. Book The Counterinsurgent s Constitution

Download or read book The Counterinsurgent s Constitution written by Ganesh Sitaraman and published by Oxford University Press. This book was released on 2013 with total page 345 pages. Available in PDF, EPUB and Kindle. Book excerpt: Since the "surge" in Iraq in 2006, counterinsurgency effectively became America's dominant approach for fighting wars. Yet many of the major controversies and debates surrounding counterinsurgency have turned not on military questions but on legal ones: Who can the military attack with drones? Is the occupation of Iraq legitimate? What tradeoffs should the military make between self-protection and civilian casualties? What is the right framework for negotiating with the Taliban? How can we build the rule of law in Afghanistan? The Counterinsurgent's Constitution tackles this wide range of legal issues from the vantage point of counterinsurgency strategy. Ganesh Sitaraman explains why law matters in counterinsurgency: how it operates on the ground and how law and counterinsurgency strategy can be better integrated. Counterinsurgency, Sitaraman notes, focuses on winning over the population, providing essential services, building political and legal institutions, and fostering economic development. So, unlike in conventional war, where law places humanitarian restraints on combat, law and counterinsurgency are well aligned and reinforce one another. Indeed, following the law and building the rule of law is not just the right thing to do, it is strategically beneficial. Moreover, reconciliation with enemies can both help to end the conflict and preserve the possibility of justice for war crimes. Following the rule of law is an important element of success. The first book on law and counterinsurgency strategy, The Counterinsurgent's Constitution seamlessly integrates law and military strategy to illuminate some of the most pressing issues in warfare and the transition from war to peace. Its lessons also apply to conflicts in Libya and other hot-spots in the Middle East.

Book Fighting Fair

  • Author : Allan C. Hutchinson
  • Publisher : Cambridge University Press
  • Release : 2015-07-08
  • ISBN : 1316395693
  • Pages : 139 pages

Download or read book Fighting Fair written by Allan C. Hutchinson and published by Cambridge University Press. This book was released on 2015-07-08 with total page 139 pages. Available in PDF, EPUB and Kindle. Book excerpt: Along with used car dealers and telemarketers, lawyers are considered to be among the least trustworthy of all professionals. If lawyers want more respect, they will have to earn it by reframing their ethical responsibilities. In an original approach to law's moral dilemma, legal theorist Allan C. Hutchinson takes seriously the idea that 'litigation is war'. By drawing an extended analogy with the theory of ethical warfare, he examines the most difficult questions facing practicing lawyers today. Comparing the role of military officers to legal professionals and theories of just peace to legal settlement, Hutchinson outlines a boldly original approach to legal ethics. Fighting Fair's recommendation for a more substantive, honor-based approach to ethics will be a thought-provoking tool for anyone concerned about the moral standing of the legal profession.
