Download or read book The Implementation of the EU Services Directive written by Ulrich Stelkens and published by Springer Science & Business Media. This book was released on 2012-02-25 with total page 657 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Services Directive is one of the cornerstones for the realization of the EU internal market and is fundamental to economic and legal experts, as well as to the general public. This book analyses in detail the different steps taken by each of the 27 EU Member States in the implementation process of the Services Directive. It provides not only detailed information about the changes in national law adopted by the Member States, but also facilitates a comparison of the different implementation strategies. It gives an insight in the heterogeneity or homogeneity of implementation concepts and shows how European legislation affects legislation that were originally nationally dominated, such as the law of national administration. Valuable for academics interested in European and administrative law and the transposition of European lawmaking into domestic law, as well as for civil servants in ministries, chambers of commerce, local governments and other comparable institutions having to implement the Directive.

Book Content Expression and Structure

Download or read book Content Expression and Structure written by Elisabeth Engberg-Pedersen and published by John Benjamins Publishing. This book was released on 1996-01-01 with total page 527 pages. Available in PDF, EPUB and Kindle. Book excerpt: This collection of papers offers an alternative to mainstream functional linguistics on two points. Especially in American linguistics, function and structure are often viewed almost as polar opposites; in addition, structure is often understood as being only a matter of linguistic form — or expression — as opposed to content. The book tries to illustrate why function and structure must be understood as mutually dependent in relation to language — and why the most interesting aspect of language structure is the way it structures the content side of language. In this, the book represents a reaffirmation of traditional concerns in structural linguistics, especially with respect to the structural integrity of individual languages — but with a reversal of traditional priority: structure is not autonomous, but must be understood on the basis of function. Without being hostile to typological and universal generalizations, the articles suggest that similarities between languages can only be responsibly discussed on the basis of an understanding that includes a respect for language differences. The book contains discussions of a number of different languages including Nahuatl, Danish Sign Language, French, and Tlapanec, and focuses on the way meaning is organized in the grammar of Danish. A final section sums up theoretical perspectives.

Book Restrictions on export of used EEE

Download or read book Restrictions on export of used EEE written by Brandt, Jacob (Bech-Bruun Law Firm) and published by Nordic Council of Ministers. This book was released on 2016-01-11 with total page 84 pages. Available in PDF, EPUB and Kindle. Book excerpt: The purpose of the report is to clarify the legal possibilities of restricting export of certain types of used EEE due to e.g. content of hazardous substances, energy consumption and/or limited market value. The focus is current environmental regulation and trade regulation which have been evaluated in order to identify if they can serve as the legal basis for setting restrictions on export. The analysis concentrates on the legal framework of trade within the rules of the internal market in the EU and the legal concept of the WTO that regulates trade between countries worldwide. The report concludes that waste regulation has very limited possibilities in regards to restricting export of used EEE. In regards to trade restrictions, it cannot be ruled out that such restrictions can be adopted in accordance with the rules of the internal market in the EU and the legal concept of WTO.

Book The Politics of Persuasion

    Book Details:
  • Author : Urs Steiner Brandt
  • Publisher : Edward Elgar Publishing
  • Release : 2016-01-29
  • ISBN : 1782546707
  • Pages : 192 pages

Download or read book The Politics of Persuasion written by Urs Steiner Brandt and published by Edward Elgar Publishing. This book was released on 2016-01-29 with total page 192 pages. Available in PDF, EPUB and Kindle. Book excerpt: The EU is at a crossroads. Should it choose the path towards protectionism or the path towards free trade? This book convincingly argues that lobbying regulation will be a decisive first step towards fulfilling the European dream of free trade, in accordance with the original purpose of the Treaty of Rome. Without the regulation of lobbyists to try and prevent undue political persuasion, there is a greater risk of abuse in the form of corruption, subsidies and trade barriers, which will come at the expense of consumers, tax payers and competitiveness. This interdisciplinary approach – both theoretical and methodological – offers a wealth of knowledge concerning the effect of lobbying on political decision-making and will appeal to academics across the social sciences, practitioners and policy-makers.

Book Interpretation of Law in the Global World From Particularism to a Universal Approach

Download or read book Interpretation of Law in the Global World From Particularism to a Universal Approach written by Joanna Jemielniak and published by Springer Science & Business Media. This book was released on 2010-04-08 with total page 378 pages. Available in PDF, EPUB and Kindle. Book excerpt: Capturing the Change: Universalising Tendencies in Legal Interpretation Joanna Jemielniak and Przemys aw Mik aszewicz International and supranational integration on the European continent, as well as the harmonisation of the rules of international trade and the accompanying dev- opment and global popularity of the resolution of commercial disputes through arbitration, constantly exerts a considerable in uence on modern legal systems. The sources of each of these phenomena are different, and their action is dissimilar. Each can be described as reaching either from the top to the bottom, through the direct involvement of interested States and consequently affecting their internal legal s- tems (international and supranational integration; harmonisation of trade regulations through public international law instruments), or bottom-up, as a result of activity by private parties, leading to the achievement of uniform practices and standards (ar- tration, lex mercatoria). Nonetheless, they both enrich national legal cultures and contribute to transgressing the limits of national (local) particularisms in creating, interpreting and applying the law. The aim of this book is to demonstrate how these processes have in uenced the interpretation of law, how they have shaped the methods and techniques of the interpretation and with what consequences for the outcomes of the interpretative procedures. In assessing the extent of this in uence, due regard must be paid to the fact that the interpretation of law is not, in principle, directly determined by the provisions of law itself.
