La pretensión es que este estudio avance hacia la incorporación de nuevas dimensiones que fortalezcan la incidencia de los Pueblos Indígenas en la transformación de estas relaciones, haciéndolas más simétricas y transparentes, en beneficio de la sociedad en su conjunto. Se seleccionaron doce experiencias de ocho países de América Latina, correspondientes a diversos sectores productivos, como la minería metálica y no metálica, la alimentación, el turismo, la gastronomía, la energía y los hidrocarburos. En estas experiencias, los Pueblos Indígenas son predominantemente negociadores de acuerdos, pero en algunos casos también participan como socios comerciales. Además, en el presente informe se incluyen casos en los cuales el Estado tiene diversos rangos de participación e influencia en el logro de acuerdos o convenios. En el estudio se muestra que, pese a que las relaciones de beneficio mutuo entre las empresas y las comunidades no son la norma, es posible establecerlas. Aun así, las relaciones positivas suelen emerger de procesos largos, del desarrollo de la confianza por ambas partes y con gran aporte de los acuerdos internacionales en la materia. Además, en el documento se recomienda a las empresas que consideren a las comunidades locales indígenas como socios, más que como beneficiarios, y alinear su misión con un mayor conocimiento y comprensión de los Pueblos Indígenas. A los estados se les recomienda garantizar el cumplimiento de las normativas internacionales y fortalecer la capacidad estatal a este respecto. La recomendación para los Pueblos Indígenas es incluir entre sus activos la incidencia y la interacción con el mundo no indígena, y por último, se recomienda a los organismos internacionales avanzar hacia el carácter vinculante de los acuerdos internacionales en la materia, entre otras recomendaciones.

While some governments and non-state actors have remained true to the Latin American tradition of resistance towards the international investment law regime, other governments and actors have sought to accommodate said regime in the region. Consequently, a profusion of theories and doctrines, too often embedded in clashing narratives, has emerged. In Latin America, the practice of international investment law is the vivid amalgamation of the practice of governments sometimes resisting and sometimes welcoming mainstream approaches; the practice of lawyers assisting foreign investors from outside and within the region; and the practice of civil society, indigenous peoples and other actors in their struggle for human rights and sustainable development. Latin America and international investment law describes the complex roles that governments have played vis-à-vis foreign investors and investments; the refreshing but clashing forces that international organizations, corporations, civil society, and indigenous peoples have brought to the field; and the contribution that Latin America has made to the development of the theory and practice of international investment law, notably in fields in which the Latin American experience has been traumatic: human rights and sustainable development.
