Book excerpt: The Military Services received a total of 6,083 reports of sexual assault involving Service members as either victims or subjects throughout fiscal year 2015, which represents a 1% decrease from the reports made in fiscal year 2014.1 Although many of these reports were for incidents that occurred in fiscal year 2015, some incidents occurred in prior years. Of the 6,083 reports of sexual assault, 5,240 were Service member victims who made a report. Of those 5,240 Service member victims, 504 victims (approximately 10%) made a report for incidents that occurred before they entered into Military Service. The United States military allows victims to make Unrestricted or Restricted Reports of sexual assault. The Military Services received 4,584 Unrestricted Reports involving Service members as either victims or subjects, a 2% decrease from fiscal year 2014. The Military Services initially received 1,900 Restricted Reports involving Service members as either victims or subjects. Four hundred and one (21%) of the initial Restricted Reports later converted to Unrestricted Reports. These 401 converted Restricted Reports are now counted with the Unrestricted Reports. Of the initial Restricted Reports, 1,499 reports remained Restricted at the end of fiscal year 2015, a 2% increase from fiscal year 2014. The Services do not investigate Restricted Reports and do not record the identities of alleged perpetrators. The Department takes appropriate action in every case where it has jurisdiction. This year, the Department had jurisdiction to take some kind of disciplinary action against 72% of military subjects. Disciplinary action was not possible for the remaining 28% of military subjects due to evidentiary or other legal factors, such as unfounded by command/legal review, victim declined to participate, insufficient evidence, statute of limitations expired, or victim died before completion of the military justice action. Appendices B and C of this report detail sexual assault data from fiscal year 2015. The major survey conducted in fiscal year 2015 was the Workplace and Gender Relations Survey for Reserve Component Members; results can be found in Annex 1 of this report. A survey to estimate fiscal year 2015 sexual assault prevalence for the Active Duty Force was not conducted this year as it is only collected on a biennial basis pursuant to Section 481 of Title 10 United States Code. Last year's survey results, however, indicated that the estimated prevalence of sexual assault within the Military Services decreased significantly for women and trended downward for men, when compared to estimated prevalence rates measured in fiscal year 2012. The Department will conduct a survey this coming fiscal year and its results will be included in the fiscal year 2016 Annual Report to update estimated prevalence rates for the Active Duty Force.

Book excerpt: Each year, the Department is required to conduct an assessment of policies and programs to address sexual harassment and sexual assault at the Military Service Academies (MSAs). The following is a brief synopsis of last year's key findings compared with this year's key findings. This Year's Key Findings - APY 12-13 Reports of sexual assault decreased at two of three MSAs, with 53 reports made by cadets and midshipmen during APY 12-13 for events they experienced while they were in military service. Of the 53 reports, 89% involved cadet/midshipman on cadet/midshipman crime. An additional 5 reports involved civilian victims who reported being sexually assaulted by a cadet or midshipman. No unwanted sexual contact rate is available, as no survey was conducted during this academic program year. A survey is being fielded in 2014 to update past-year prevalence rates of unwanted sexual contact and sexual harassment. The 53 victims who reported a sexual assault for an incident that occurred while they were in military service during APY 12-13 is less than the 58 victims that reported in APY 11-12. Because there was no survey to establish a prevalence rate for this past academic year, the Department cannot say with certainty whether the decrease in reporting this year at the MSAs was due to fewer assaults occurring, or due to fewer victims opting to report. Given focus group feedback, cadets and midshipmen feel that incidents would be taken seriously by MSA leadership and dealt with immediately. However, they remain concerned that reporting a sexual assault will impact their reputation and social standing with classmates. In the report that follows, the Department has made numerous recommendations that will help address perceptions that deter reporting, and advance and sustain an environment of dignity and respect at the MSAs.

Book excerpt: Incidents of sexual harassment and assault contradict the academies' core values to treat all with dignity and respect. Yet, since 2003, each of the Department of Defense (DOD) academies and the Coast Guard Academy has experienced at least one incident. In 2003, Congress directed DOD to establish programs and to submit annual reports, and although not required, the Coast Guard Academy, within the Department of Homeland Security, has taken similar action. GAO was asked to review sexual harassment and assault programs at the academies. This report evaluates (1) the academies' programs to prevent, respond to, and resolve sexual harassment and assault cases; (2) the academies' visibility over sexual harassment and assault incidents; and (3) DOD and Coast Guard oversight of their academies' efforts. GAO analyzed data for program years 2003 through 2006, reviewed requirements, met with service and academy officials, and interviewed randomly selected students at each academy. GAO suggests that Congress consider requiring the Coast Guard Academy to submit data for DOD's annual report and to participate in assessments methodologically comparable to those administered by DOD. GAO is also making recommendations to DOD and the Coast Guard to improve oversight of sexual assault and harassment at their academies. Both agencies concurred or partially concurred with GAO's recommendations.

For Academic Program Years (APY) that begin in odd-numbered years, as is the case this year (e.g., APY 11-12), the assessment consists of a survey of the cadets and midshipmen conducted by the Defense Manpower Data Center (DMDC) and each Academy s sexual harassment and violence self-assessment report. The Department of Defense (DoD) Sexual Assault Prevention and Response Office (SAPRO) and the Office of Diversity Management and Equal Opportunity (ODMEO) use this annual assessment as an oversight and compliance tool to monitor improvement of the MSAs Sexual Assault Prevention and Response (SAPR) and Prevention of Sexual Harassment (POSH) Programs. To that end, the assessment of the SAPR and POSH Programs was organized by the priorities established in the DoD-wide SAPR Strategic Plan approved in December 2009. The MSA self-assessments describe institutionalized and evolving training programs for prevention and response to sexual harassment and assault. For cadets and midshipmen, this training begins at accession and continues throughout their four years at the academy. Each MSA s effort to improve its policies and training demonstrates a commitment to prevention and support for a climate where victims may confidently report the crime and receive needed assistance. As with prior years, the MSAs employed leaders in the field of sexual violence prevention to inform their programming and educate cadets and midshipmen."--Abstract.

Until April 29, 2013, however, when National Basketball Association center Jason Collins came out publicly as gay, not one of those tens of thousands of men had ever come out to the public as gay while an active player on a major league roster. Is it because gay men can't jump (or throw, or catch, or skate)? Or is it more likely that the costs of coming out are too high? In Antigay Bias in Role-Model Occupations, E. Gary Spitko argues that in the case of athletes, and others in role-model occupations, a record of widespread and frequently systematic employment discrimination has been excluding gay people from the public social spaces that identify and teach whom society respects and whom members of society should seek to emulate. Creating a typology of role models—lawyers/judges, soldiers, teachers, politicians, athletes, and clergy—and the positive values and character traits associated with them, Spitko demonstrates how employment discrimination has been used for the purpose of perpetuating the generally accepted notion that gay people are inferior because they do not possess the requisite qualities—integrity, masculinity, morality, representativeness, all-American-ness, and blessedness—associated with employment in these occupations.
