Book excerpt: This book takes the reader on a sweeping tour of the international legal field to reveal some of the patterns of difference, dominance, and disruption that belie international law's claim to universality. Pulling back the curtain on the "divisible college of international lawyers," Anthea Roberts shows how international lawyers in different states, regions, and geopolitical groupings are often subject to distinct incoming influences and outgoing spheres of influence in ways that reflect and reinforce differences in how they understand and approach international law. These divisions manifest themselves in contemporary controversies, such as debates about Crimea and the South China Sea. Not all approaches to international law are created equal, however. Using case studies and visual representations, the author demonstrates how actors and materials from some states and groups have come to dominate certain transnational flows and forums in ways that make them disproportionately influential in constructing the "international." This point holds true for Western actors, materials, and approaches in general, and for Anglo-American (and sometimes French) ones in particular. However, these patterns are set for disruption. As the world moves past an era of Western dominance and toward greater multipolarity, it is imperative for international lawyers to understand the perspectives and approaches of those coming from diverse backgrounds. By taking readers on a comparative tour of different international law academies and textbooks, the author encourages them to see the world through the eyes of others -- an essential skill in this fast changing world of shifting power dynamics and rising nationalism.

We'll examine the security, political, legal, and economic drivers of these disputes in our three panels today. The first panel will begin by discussing the broad security situation on the high seas. As China's maritime forces have become more capable over the past decade, Beijing has become more confident in its ability to assert its claims in the disputed areas. Beyond China's "hard" security concerns, however, other domestic, political, and legal elements shape China's policy in the East and South China Seas. Our second panel will consider popular nationalism as one of these elements. It has become a key driver of Chinese foreign policy as personality politics in Beijing has given way to a collective leadership seeking Party legitimacy. We'll conclude with a panel on how resources and economic drivers shape China's maritime disputes. Security of China's near seas is critical to the unimpeded flow of trade and imported energy resources. Though the natural resources in the East and South China Sea undoubtedly shape the security landscape, there appears to be a debate on the centrality of oil and gas resources to the dispute.

It considers the influence of Timor-Leste’s historical experiences with foreign intervention on how the small, new state has pursued security. The book argues that efforts to secure the Timorese state have been motivated by a desire to reduce foreign intervention and dependence upon other actors within the international community. Timor-Leste’s desire for ‘real’ independence — characterized by the absence of foreign interference — permeates all spheres of its international political, cultural and economic relations and foreign policy discourse. Securing the state entails projecting a legitimate identity in the international community to protect and guarantee political recognition of sovereign status, an imperative that gives rise to Timor-Leste’s aspirational foreign policy. These are defined as the Pacific and Indian Oceans and associated seas, bays, and gulfs, with their included sea lines of communication (SLOCs). The most useful geographical designation for maritime Asia is the “Indo-Pacific.” Bernard Cole provides both a survey of the maritime strategies of the primary nations of the Indo-Pacific region and an evaluation of the domestic and international politics that drive those strategies. The United States, Canada, Russia, Japan, North Korea, South Korea, China, the Philippines, Brunei, Indonesia, Vietnam, Singapore, Malaysia, Myanmar, India, Pakistan, Iran, the smaller Indian Ocean and Persian Gulf states are all surveyed and analyzed. The United States, Japan, China, and India not surprisingly draw the most attention, given their large modern navies and distant strategic reach. The author concludes that the United States remains the dominant maritime power in this huge region, stretching from Canada to the Persian Gulf, despite its lack of a traditionally strong merchant marine. U.S. maritime power remains paramount, due primarily to its dominant navy. The Chinese naval modernization program deservedly receives a good deal of public attention, but Cole argues that on a day-to-day basis the Japanese Maritime Self-Defense Force, as its navy is named, is the most powerful maritime force in Far Eastern waters, while the modernizing Indian Navy potentially dominates the Indian Ocean. In fact, a focus of this work is the exemplary description of all the region’s navies, with the author noting the naval arms race that is underway, particularly in the area of submarine acquisition. Cole is careful to couch this phenomenon in the regional concerns about Chinese naval expansion and the desire to ensure a continued, massive U.S. naval presence. The current naval developments in the region evince elements of a naval arms race, but lack the coherent maritime strategies to make naval developments dangerous to regional peace and security. Most telling will be whether United States power and focus remain on the region, while adjusting to continued Chinese maritime power in a way acceptable to both nations. No other current or recent work provides such a complete description of the Indo-Pacific region’s navies and maritime strategies, while analyzing the current and future impact of those forces.
