Cette institution est considérée comme l'une des banques les plus prestigieuses du secteur bancaire international jusqu'au 15 septembre 2008. De cette faillite, les uns se souviennent d'une comparaison avec le jeudi noir de 1929, les autres analysent les causes d'une défaillance systémique des établissements bancaires. Les crises bancaires sont des phénomènes économiques récurrents. Elles entrainent des vagues de licenciements, la perte d'une épargne, le retrait des investisseurs, le frein du développement des économies nationales.Gérer le risque de défaillance bancaire oblige à connaître les acteurs et le fonctionnement du système bancaire. A travers un prisme volontairement historique, le développement de la norme supervisant ce secteur économique est mis en évidence. Sans solution de prévention contre les faillites, la quête est vaine. Pour ce faire, la puissance publique contraint les établissements bancaires à adapter leurs structures aux opérations spéculatives et à se doter de fonds propres. Parallèlement, des solutions doivent limiter les conflits d'intérêts issus des rémunérations du risque financier et de l'interdépendance des banques et des agences de notation. Sans prévention des risques, un traitement proportionné est la seule solution aux défaillances. Cette finalité laisse supposer l'application d'une norme relevant du droit commun. En effet, une banque en faillite peut être liquidée. Néanmoins, les enjeux financiers et l'internationalisation des relations interbancaires contraignent les Etats à développer un traitement de résolution unique. Dérogeant aux normes de droit commun, le traitement des défaillances résulte de procédures extra-judiciaires spéciales. Elles mettent en place des dispositifs efficaces rétablissant la viabilité de l'entité économique, conservant la stabilité du système bancaire et garantissant l'épargne des clients. Cette analyse des défaillances bancaires menée par l'auteur vise à considérer un phénomène économique juridiquement encadré par un droit autonome et éviter la survenance du risque de défaut.

In particular, respect for the rule of law, a low level of corruption, and good contract enforcement are relevant institutional characteristics. the data also show that, after liberalization, financially repressed countries tend to have improved financial development even if they experience a banking crisis. This is not true for financially restrained countries. This paper’s results support a cautious approach to financial liberalization where institutions are weak, even if macroeconomic stabilization has been achieved.

Book excerpt: Relations between organized labor and environmental groups are typically characterized as adversarial, most often because of the specter of job loss invoked by industries facing environmental regulation. But, as Brian Obach shows, the two largest and most powerful social movements in the United States actually share a great deal of common ground. Unions and environmentalists have worked together on a number of issues, including workplace health and safety, environmental restoration, and globalization (as in the surprising solidarity of "Teamsters and Turtles" in the anti-WTO demonstrations in Seattle). Labor and the Environmental Movement examines why, when, and how labor unions and environmental organizations either cooperate or come into conflict. By exploring the interorganizational dynamics that are crucial to cooperative efforts and presenting detailed studies of labor-environmental group coalition building from around the country (examining in detail examples from Maine, New Jersey, New York, Washington, and Wisconsin), it provides insight into how these movements can be brought together to promote a just and sustainable society. Obach gives a brief history of relations between organized labor and environmental groups in the United States, explores how organizational learning can increase organizations' ability to work with others, and examines the crucial role played by "coalition brokers" who maintain links to both movements. He challenges research that attempts to explain inter-movement conflict on the basis of cultural distinctions between blue-collar workers and middle-class environmentalists, providing evidence of legal and structural constraints that better explain the organizational differences class-culture and new-social-movement theorists identify. The final chapter includes a model of the crucial determinants of cooperation and conflict that can serve as the basis for further study of inter-movement relations.
