The term evokes images of militarization, punishment, and violence, as well as combat and the potential for victory. It is no surprise then that questions such as whether the "War on Drugs" has "failed" or "can be won" have animated mass media and public debate for the past 40 years. Through analysis of 30 years of newspaper content, Debating the Drug War examines the social and cultural contours of this heated debate and explores how proponents and critics of the controversial social issues of drug policy and incarceration frame their arguments in mass media. Additionally, it looks at the contemporary public debate on the "War on Drugs" through an analysis of readers’ comments drawn from the comments sections of online news articles. Through a discussion of the findings and their implications, the book illuminates the ways in which ideas about race, politics, society, and crime, and forms of evidence and statistics such as rates of arrest and incarceration or the financial costs of drug policies and incarceration are advanced, interpreted, and contested. Drawing on a sample of recent Spanish legislation, the papers collected here analyse (critically) the rationale of several laws or legislative measures as it can be reconstructed from the respective parliamentary discussions. All issues covered have given rise to intense political, legal and social controversy: they range from the combat against gender violence, the legal status of bullfighting, the protection of crime victims and the so-called ‘push-backs’ at the border, to the regulation of euthanasia, the minimum living income, underage girls’ access to abortion, and joint child custody. The volume is organised into two main parts. The first group of case studies adopt a legisprudential perspective and examine parliamentary deliberations in the light of the theory and methodology of legislative justification; the contributions in the second part follow approaches that fall outside – but are largely compatible with –legisprudence, and deal with aspects such as the rhetorical strategies employed by MPs when debating bills, and the role of elected legislators as constitutional interpreters.

The project of neoliberalism was said to be that of rolling back the state to liberate individuals, by replacing government bureaucracy with the free market. Rather than have the market serve individuals however, individuals were to serve the market. The marketisation ‘reforms’ in higher education, which sought to reshape knowledge production, with students investing in human capital and academics producing ‘transferable’ research, to make higher education of use to the economy, has resulted in extensive government bureaucracy and oppressive managerialist bureaucracy which is inefficient and expensive. Neoliberalism has always had authoritarian aspects and these are now coming to bear on universities. The state does not want critical and informed graduate citizens, but a hollowed out public sphere defined by consumption, willing servitude to the market and deference to state power. Attempts to reshape universities with bureaucracy are now accompanied by a culture war, attacking the production of critical knowledge. The authors in this book explore these issues and the possibilities for resistance and progressive change.
