Book excerpt: Many laws in the Old Greek translation of the Covenant Code do not say the same thing as the Hebrew text. In the past, various idiosyncrasies in the Greek translation of laws that involve the death penalty had been glossed over and considered stylistic variations or grammatical outliers. However, when the text-linguistic features of the Greek translation are compared to contemporary literary, documentary, and legal Greek sources, new readings emerge: cursing a parent is no longer punishable by death; a law about bestiality becomes a law about animal husbandry; the authority of certain legal commands is deregulated. This work explores these and other new readings in comparison with contemporary Greco-Egyptian law.

Book excerpt: Most scholars believe that the numerous similarities between the Covenant Code (Exodus 20:23-23:19) and Mesopotamian law collections, especially the Laws of Hammurabi, which date to around 1750 BCE, are due to oral tradition that extended from the second to the first millennium. This book offers a fundamentally new understanding of the Covenant Code, arguing that it depends directly and primarily upon the Laws of Hammurabi and that the use of this source text occurred during the Neo-Assyrian period, sometime between 740-640 BCE, when Mesopotamia exerted strong and continuous political and cultural influence over the kingdoms of Israel and Judah and a time when the Laws of Hammurabi were actively copied in Mesopotamia as a literary-canonical text. The study offers significant new evidence demonstrating that a model of literary dependence is the only viable explanation for the work. It further examines the compositional logic used in transforming the source text to produce the Covenant Code, thus providing a commentary to the biblical composition from the new theoretical perspective. This analysis shows that the Covenant Code is primarily a creative academic work rather than a repository of laws practiced by Israelites or Judeans over the course of their history. The Covenant Code, too, is an ideological work, which transformed a paradigmatic and prestigious legal text of Israel's and Judah's imperial overlords into a statement symbolically countering foreign hegemony. The study goes further to study the relationship of the Covenant Code to the narrative of the book of Exodus and explores how this may relate to the development of the Pentateuch as a whole.

The latter is simple and short. A member of clan A has weakened clan B by killing one of its members. Clan B must retaliate by weakening the aggressor clan at least as much. This policy, however wise as against another clan, would be ruinous if applied within the clan. One member has killed another, and has thereby reduced the strength of the clan. If the aggressor be killed, its strength is further reduced. The direct clan-interest is that the aggressor be kept alive, unless he is likely to further imperil the community. It is this contingency which creates a necessity for devising a lesser punishment than death for homicide within the clan, and hence is evolved the system of imposing a money penalty on the homicide It is this contingency, too, which creates a necessity for ascertaining the circumstances of the tragedy and its underlying motive. Hence follows a subdivision of homicide into murder, which even within the clan may continue to be a capital offence, and manslaughter, which may readily be compounded for. Book excerpt: The slaughter of animals as a religious ritual and the execution of human beings as a judicial one was an interrelated phenomenon in the ancient world. Writings from different traditions had to be interpreted in relation to each other for the connection between two sacred rituals to be made. The history of the death penalty within the textual traditions of Judaism and ancient Greece could be traced to specific commandments beginning in Genesis and in laws specified as early as in Hesiod’s Theogony—in each case, however, with far from unambiguous conclusions despite their divine origins in YHWH or Zeus. An ever-present uncertainty in the nature of the death penalty pervades the writings of the Bible from Genesis to the Gospels of Jesus, as well as in the mytho-poetic world of Hesiod, the tragedy of Aeschylus, and Socratic philosophy as represented in Plato’s dialogues. Scholarship has not considered the importance of these two interrelated traditions insofar as both expose the specific characteristics of violence and killing within the institutions of religion and the law. The creation of religious rituals and the acts of the law are inseparable and essential to the authority of the politico-religious state. Animal sacrifice and the death penalty serve as the pillars of social legitimacy in the ancient world.

Ever since Assyriologists began to recognize that the Mesopotamian law collections did not function as law codes do today—as a source of binding obligation—scholars have grappled with the question of when the Pentateuchal legal corpora came to be treated as legally binding. Vroom draws from legal theory to provide a theoretical framework for understanding the nature of legal authority, and develops a methodology for identifying instances in which legal texts were treated as binding law by ancient interpreters. This method is applied to a selection of legal-interpretive texts: Ezra-Nehemiah, Temple Scroll, the Qumran rule texts, and the Samaritan Pentateuch.
