Book excerpt: La principal preocupaci?n de las administraciones y de los productores de alimentos de calidad es que los consumidores puedan llegar a descifrar el significado de una denominaci?n o indicativo de calidad. En la pretensi?n del legislador comunitario est? la de simplificar el sistema y las distintas etiquetas para que el consumidor pueda conocer el producto alimenticio que adquiere. El conocimiento del significado de la etiqueta de calidad determina una mayor confianza del consumidor con respecto al producto y sus caracter?sticas. La Denominaci?n de origen y las indicaciones geogr?ficas son representativas de una calidad determinada. Su regulaci?n jur?dica, a diferencia de las marcas, participan de normas de derecho p?blico y no restan sometidas al exclusivo sometimiento del derecho privado. Ello acrecienta la trascendencia social o colectiva de su tutela, esencialmente la protecci?n de los intereses de consumidores y usuarios, que se coloca en primer t?rmino, as? como la necesaria claridad en las ofertas de productos que se abocan al mercado. Presentan notas espec?ficas con respecto a los signos distintivos a los que en mayor medida pudieran ser homologados: las marcas colectivas y de garant?a. Estas denominaciones son signos distintivos cuyo objeto es proteger la calidad de los productos que se incorporan al tr?fico econ?mico. La norma marco reguladora de las denominaciones de origen data de 1970, y estaba referida a la regulaci?n del Estatuto del Vino, la Vi?a y los Alcoholes. Como es notorio, el r?gimen de protecci?n de las denominaciones de origen se ha ido extendiendo a otros productos agroalimentarios. As?, se incorporaron dos nuevas categor?as: las denominaciones gen?ricas y la Denominaci?n espec?fica. Las denominaciones gen?ricas presentan caracter?sticas diferenciadoras con respecto a las denominaciones de origen. Los atributos de los productos amparados por una denominaci?n gen?rica no se sustentan en el medio geogr?fico; hacen referencia a la naturaleza de los productos, a los sistemas de producci?n o a los m?todos de elaboraci?n y transformaci?n. La denominaci?n gen?rica se aplicar? a los grupos de productos que, pudiendo producirse en todo el territorio nacional, tienen naturaleza com?n y se diferencian por su calidad de otros semejantes. Se entiende por Denominaci?n Gen?rica la calificaci?n aplicable a los productos que tienen caracteres comunes y especiales debidos a su naturaleza, a los sistemas de producci?n empleados o a los procedimientos de transformaci?n, elaboraci?n y fabricaci?n. La claridad en la delimitaci?n entre denominaciones de origen y denominaciones gen?ricas se ha visto enturbiada de modo creciente. Podemos destacar dos factores: por un lado, la normativa permite la utilizaci?n en el nombre de la denominaci?n gen?rica de menciones geogr?ficas; y por otro, la pr?ctica llevada a cabo por diferentes Comunidades Aut?nomas de acu?ar "denominaciones gen?ricas de calidad". Otro tipo de denominaci?n es la denominada denominaci?n espec?fica que se define como la calificaci?n aplicable a un producto que tiene cualidades diferenciales entre los de su misma naturaleza debidas a la materia prima base de su elaboraci?n, al medio natural o a los m?todos de elaboraci?n. A ella incluso se pueden incorporar referencias al origen geogr?fico cuando el producto se comercialice habitualmente con dicho nombre y la obtenci?n de la materia prima, as? como los procesos de elaboraci?n y transformaci?n se realicen en un ?rea geogr?fica delimitada en relaci?n con dicho nombre geogr?fico y la calidad y especificidad del producto amparado dependan del mismo. Book excerpt: The first case study deals with the mad cow fiasco of 1996, one of the most expensive and tragic examples of poor risk management in the last twenty-five years. For ten years the British government failed to acknowledge the possibility of a link between mad cow disease and Creuzfeldt-Jakob disease, the human equivalent, until increased scientific evidence and public pressure forced them to take action, resulting in the slaughter of more than one million cattle. The second study looks at what is commonly known as hamburger disease, caused by a virulent form of the E. coli bacterium, which has struck thousands and killed over thirty people in the last few years. Despite its widespread effects, it is unclear whether scientific knowledge on preventing the disease is reaching the public. Other case studies include the use of a genetically engineered hormone to increase milk production in cows, health risks associated with silicone breast implants, public controversies surrounding dioxins and PCBs, and the introduction of agricultural biotechnology. These case studies show that institutions routinely fail to communicate the scientific basis of various high-profile risks. These failures to inform the public make it difficult for governments, industry, and society to manage risk controversies sensibly and often result in massive costs.
