Book excerpt: El daño a la integridad física y psíquica del ser humano sigue siendo una preocupación presente en la sociedad, lo que patentiza el hecho de que los distintos sistemas jurídicos traten de extender su cobertura progresivamente para garantizar que toda persona obtenga una reparación integral por las lesiones que se le han causado. En este contexto, desde hace ya algunos años se viene advirtiendo que, en muchas ocasiones, el menoscabo de la integridad corporal deja a la víctima en un estado lesionado de tal gravedad que acaba repercutiendo, de un modo u otro, en la esfera moral y/o patrimonial de sujetos ligados a ella por un vínculo afectivo, económico o profesional. Estos últimos daños son conocidos, por razón del distinto sujeto que los padece frente al lesionado inicialmente, como daños indirectos o por rebote y, aunque hasta la fecha han recibido escasa atención doctrinal, la mayoría de ordenamientos jurídicos contemplan su reparación. Se trata esta de una tipología de daños con una fisonomía peculiar que, si bien se rige por las reglas generales de la responsabilidad civil, despierta múltiples interrogantes, sobre todo en lo que concierne a su nomenclatura, fundamento legal, imputación objetiva al agente, autonomía con respecto al daño inicial y determinación de sus partidas indemnizatorias. La relevancia práctica de la figura es cada vez más palpable, especialmente en el ámbito de los accidentes de tráfico y de las negligencias médicas, y se prevé que su proyección vaya en aumento debido al avance de la ciencia y de la tecnología, así como a la transformación de las propias relaciones que se dan entre las personas. Ante la actual indeterminación de sus perfiles, la presente monografía tiene por fin ofrecer al lector un análisis jurídico-privado exhaustivo del daño indirecto o por rebote por causa de lesiones que permita sostener su vigencia en nuestro Derecho y responder a los múltiples interrogantes que su reconocimiento despierta. A tal efecto, se realiza un recorrido histórico-jurídico de la figura y se aborda de forma completa el tratamiento doctrinal y jurisprudencial que ha recibido en países de nuestro entorno. Tras ello, e integrando algunas de las soluciones del Derecho extranjero, se procede a la delimitación de la figura en nuestro país, se sientan los presupuestos estructurales para su reconocimiento y se determinan las específicas partidas indemnizatorias que integran en la actualidad esta tipología de daños.Lucía Molina Martínez es graduada en Derecho y Administración y Dirección de Empresas (2017) por la Universidad de Alicante y ha cursado, en la misma institución académica, los Másteres de Acceso a la Abogacía (2019), Derecho de Daños (2020) y Derecho de la Sociedad Digital (2022). Su actividad docente e investigadora comenzó en el año 2020 en el Departamento de Derecho civil de la Universidad de Alicante y, fruto de su formación especializada, su línea de investigación se ha centrado en materia de responsabilidad civil y nuevas tecnologías. Desde 2023 es Doctora en Derecho, tras la defensa de su tesis doctoral en la Universidad de Alicante, obteniendo la calificación de sobresaliente Cum-laude por unanimidad con mención internacional. En la actualidad, es miembro integrante de proyectos públicos de investigación, a nivel estatal y autonómico, centrados en la irrupción de la Inteligencia Artificial en el Derecho de Daños.
