The European Union's security and defence policy has long been the focus of political scientists and international relations experts. However, it has more recently become of increasing relevance to lawyers too. Since the early 2000s, the EU has carried out more than two dozen security and defence missions in Europe, Africa, and Asia. The EU institutions are keen to stress the security dimension of other external policies also, such as development cooperation, and the Lisbon Treaty introduces a more detailed set of rules and procedures which govern the CSDP. This book provides a legal analysis of the Union's CSDP by examining the nexus of its substantive, institutional, and economic dimensions. Taking as its starting point the historical development of security and defence in the context of European integration, it outlines the legal framework created by the rules and procedures introduced by the Treaty of Lisbon. It examines the military operations and civilian missions undertaken by the Union, and looks at the policy context within which they are carried out. It analyses the international agreements concluded in this field and explores the links between the CSDP and other external policies of the Union.

This learning process was driven by transnational communities of experts and practitioners, which acted as engines of change. Giovanni Faleg analyses two innovative concepts introduced in the EU security discourse since the late 1990s: security sector reform (SSR) and civilian crisis management (CCM). Both stem from a new understanding of security, involving the development of non-military approaches and a comprehensive approach to crisis management. However, the implementation of the two policy frameworks by the EU led to very different outcomes. Peacebuilding carried out through CSDP instruments has become central to the self-conception of the EU as an actor in international conflict management. EU missions and operations have, for the most part, been deployed to promote peacebuilding efforts in post-conflict situations, in particular through capacity-building, reforms and rebuilding of state structures. This book focuses explicitly on the peacebuilding dimension of the CSDP while exploring why and how the EU has adopted peacebuilding in its CSDP actions as a norm and a practice. It analyses how peacebuilding in EU missions is conceptualised, designed, governed and implemented. The book examines the extent to which EU missions and operations reflect a normative and practical commitment of the EU to peacebuilding - that is to say, the extent to which CSDP instruments have been shaped by international peacebuilding norms and EU foreign policy. Divided into 12 chapters, with 7 appendices, the report covers the following areas, including: foundations of the European Union, where the Committee analyses the effects of the changes to the structure of EU treaties and the amendments made to the Union's values and objectives; the simplified treaty revision and how this can alter significantly the provisions on the face of all European Treaties; the impact of the Treaty on European institutions and what changes this will make to the European Council, including a full-time European Council President; the Lisbon Treaty gives the Charter of Fundamental Rights a legally binding status and whether the Charter's rights will create "new" rights in the UK and if the UK's existing labour and social legislation will be effected; the area of freedom, security and justice; how far does the Treaty change fundamental principles of foreign, defence and development policies; the impact of the Treaty on social affairs as well as finance and the internal markets; the impact on environment, agriculture and fisheries; also the new functions the Treaty gives national parliaments and the democratic challenge that poses; a summary of conclusions. The report does not seek to compare the Lisbon Treaty with the now abandoned Constitutional Treaty or the process by which the Lisbon Treaty was produced.
