Book excerpt: This book deals with the gathering of evidence in cross-border investigations in Europe. The issue of obtaining evidence in and from European countries has been among the most debated issues of EU cross-border cooperation in criminal matters over the last two decades, going through periods of intensive discussions and showing an extraordinary adaptability to the evolution of EU legislation for criminal matters. On the other hand, the prosecution and investigations of cross-border cases pose unprecedented challenges in the European scenario, characterized by the increasing flow and activity of citizens over the territory of more than one country and therefore by the need to lay the foundations of a transcultural criminal justice system. The book analyses this complex topic starting with the current perspectives of EU legislation, thus providing a critical analysis of the legislative initiative aimed at introducing a new tool for gathering almost any type of evidence in other Member States, i.e., the European Investigation Order. On a second level, this study deals with the solution models and human rights challenges posed by the increasingly intensive dialogues between domestic and supranational case laws, and formulates essential guidelines for setting up a fair transnational enquiry system in Europe.

The EU’s Internal Security Strategy, adopted by the Spanish presidency early in 2010, followed the Lisbon Treaty in 2009, building on previous developments within the EU in the Area of Freedom Security and Justice (AFSJ) policy. The focus of the EU Internal Security Strategy is to prevent and combat “serious and organised crime, terrorism and cybercrime, in strengthening the management of our external borders and in building resilience to natural and man-made disasters”. The Internal Security strategy intersects and overlaps with the European Union’s Counter-terrorism strategy, the Strategy for the External Dimension of JHA, and the EU’s Security Strategy. The role of and interaction between these strategies, their supplementing documents, and their implications for crime, victims, the law, political relations, democracy and human rights, form the backdrop against which the chapters in this collection are written. Building on original research by its contributors, this collection comprises work by authors from a wide variety of academic and professional areas and perspectives, as well as different countries, on a variety of areas and issues related to or raised by the EU’s Internal Security Strategy, from intelligence-led policing to human trafficking and port security. This book examines, from a wide variety of disciplinary perspectives including law, geography, politics and practice, both this further refinement of existing internal provisions on cross-border crime, and the increasing external relations of the EU in the AFSJ.

This does not mean that all sorts of new crime are emerging: a large part of the crimes remains profit-oriented and is committed by known modus operandi. That is the old face of crime. Amidst the traditional landscape new faces of crime can be identified. The internet is such a new face which emerges among others in the sex industry. This is as old as the human race, with all the related abuses and exploitation. But the internet gives it also a new face because of its broad reach and related opportunities, negative as well as positive. This volume provides other examples of this two-faced Janus head of crime. Old criminal trades, such as the illegal cigarette market, synthetic drugs and criminal exploitation of human labour, but also new criminal specialisations, new professional and industrial skills developed by 'old' ethnic minorities on various crime markets in central Europe. Meanwhile, the on-going illegal migrations continue to exert their influence on the perception of crime: while the actual prevalence of most types of crime decreases, fear of crime continues to increase. The flow of migrants is unrelated to this outcome but it impacts nevertheless on the perception of crime. This volume of the 18th Cross-border Crime Colloquium, held in Bratislava in the spring of 2017, contains the peer-reviewed contributions of 22 European experts and up-and-coming researchers.
