Available in PDF, EPUB and Kindle. Book excerpt: The hermeneutic path involved in the interpretation of law as well as in the interpretation of sacred texts, though peculiar, seems - as Emilio Betti pointed out - to share several things, most importantly the "normative" nature of interpretation. The 1999 issue of the Yearbook "Ars Interpretandi" accounts for the several and disparate relationships between these two important "regional hermeneutics".

Available in PDF, EPUB and Kindle. Book excerpt: The contributions to this volume are concerned with the Roman law of antiquity in its broadest sense, covering both private and public law from the Roman Republic to the Byzantine era, including legal papyrology. They also examine the reception of Roman law in Western Europe and its colonies (specifically the Dutch East Indies) from the Middle Ages to the promulgation of the German Bürgerliche Gesetzbuch in 1900. They reflect the wide interests of Professor Boudewijn Sirks, whom the volume honours on the occasion of his retirement and whose work and career have transcended frontiers and nations.

Book Dante the Limits of the Law

Download or read book Dante the Limits of the Law written by Justin Steinberg and published by University of Chicago Press. This book was released on 2013-12-22 with total page 240 pages. Available in PDF, EPUB and Kindle. Book excerpt: In Dante and the Limits of the Law, Justin Steinberg offers the first comprehensive study of the legal structure essential to Dante’s Divine Comedy. Steinberg reveals how Dante imagines an afterlife dominated by sophisticated laws, hierarchical jurisdictions, and rationalized punishments and rewards. He makes the compelling case that Dante deliberately exploits this highly structured legal system to explore the phenomenon of exceptions to it, crucially introducing Dante to current debates about literature’s relation to law, exceptionality, and sovereignty. Examining how Dante probes the limits of the law in this juridical otherworld, Steinberg argues that exceptions were vital to the medieval legal order and that Dante’s otherworld represents an ideal “system of exception.” In the real world, Dante saw this system as increasingly threatened by the dual crises of church and empire: the abuses and overreaching of the popes and the absence of an effective Holy Roman Emperor. Steinberg shows that Dante’s imagination of the afterlife seeks to address this gap between the universal validity of Roman law and the lack of a sovereign power to enforce it. Exploring the institutional role of disgrace, the entwined phenomena of judicial discretion and artistic freedom, medieval ideas about privilege and immunity, and the place of judgment in the poem, this cogently argued book brings to life Dante’s sense of justice.

Book Origins of Legislative Sovereignty and the Legislative State

Download or read book Origins of Legislative Sovereignty and the Legislative State written by A. London Fell and published by Praeger. This book was released on 1983 with total page 520 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is the fourth in a projected eight-volume series that addresses the origins and development of the idea of legislative sovereignty and the legislative state. A. London Fell's study, which traces ideas and contributions from the Renaissance thinker and legal scholar Corasius to the present, has been praised by such scholars as J. Russell Major in American Historical Review and Dennis M. Patterson in The American Political Science Review. In this volume, the focus is on ancient, medieval, and early modern Europe, as Fell charts the overall patterns of historiographical debates in modern discussion on the origins of legislation, public law, sovereignty, and the state. The work begins with a brief introduction, and is followed by six sections that cover the different periods and geographical aspects of the topic from a historiographical perspective. Section one proceeds chronologically throughout the entire spectrum of early Europe, from the ancient and medieval periods, through the Renaissance and Reformation, to post-sixteenth-century developments. In each case, the theories that attribute the origins of state to that period are thoroughly examined. In sections two through six, the study proceeds on a nation-by-nation basis, focusing in each case first on the Middle Ages and then on the Renaissance. The nations covered include Italy, France, England, Germany, Spain, and the Netherlands. The study concludes with a summary chapter, followed by a series of supplemental bibliographical essays that serve as an appendix to the first four volumes. Like the previous volumes in the series, this work is a substantial contribution to the study of jurisprudence and political theory, and will be an important reference source for students and professors of history, law, and political science, as well as philosophy.
