There has been an increase in the number of politicians with criminal backgrounds who have been elected as legislative representatives in the past few decades. This raises the question as to why Indians elect criminal politicians. The causes of crime in India are classified into social, economic, political, geographic, mental and psychological, and biological. Criminalization of politics in India takes many forms, and include electoral fraud, political candidates with criminal backgrounds contesting elections, use of muscle power in mobilizing voters, political scams, bureaucratic scams, and politicians protecting criminal gangs. Some of the causes of criminalization of politics in India include political control of the police, state money, corruption, weak laws and abuse of discretion, lack of intraparty democracy transparency, lack of ethics or values, vote bank politics, and loopholes in the functioning of the Election Commission. Ignorance due to illiteracy is prevalent as approximately 25% of the population are illiterate. Ethnic identity is the most important factor in Indian politics. Ethnic identity includes caste, religion, and language. Competition over local dominance among various social groups is one of the major factors that makes Indian voters elect politicians with a criminal history. Most of the media houses have their political affiliations, and they continue to indulge in perception mapping of public. Indian voters elect criminals due to the perceived benefits they would receive from them since the politicians would have huge discretionary powers over the implementation of policies that facilitate the distribution of benefits to the public. Indian voters also vote for politicians with a criminal record due to being coerced. Candidates with criminal links provide the electorate with a form of social insurance. The ability of candidates with criminal links to provide platforms that facilitate dispute resolutions is also one of the factors that make Indian voters choose politicians with criminal links. Having a weak rule of law in India is the major factor that has led to the thriving of the alternative forms of dispute resolution. The election of candidates with a criminal record has several impacts. It leads to an increase in the level of political control of the police. The criminal politicians can use the police to achieve their personal goals. The governance delivered by the criminal politicians may contradict the prevailing principles of good governance in a democratic system. For instance, they may engage in practices that favor certain groups within the society to the detriment of other groups. Politicians with a criminal background create negative economic impacts. These politicians can use their discretionary powers in the allocation of public resources to the state-controlled corporations to engage in corrupt activities that enrich them or their benefactors. Therefore, they may embezzle public resources or allocate the public resources to private parties for their refinement or development, which would have a negative impact on the welfare of the residents of the region. Criminal politicians can also treat public resources as their personal assets and use them to engage in various criminal activities. It would lead to the breakdown of the rule of law since the politicians would support criminal activities conducted by their cronies. This may lead to the proliferation of criminal organization, which would be a threat to peace and security and also lead to the loss of public faith in the credibility of the judiciary. The situation is alarming and needs to be controlled before it goes out of hand and threatens the future social economic development of the country. These are the major issues that are discussed in this book.

This book retraces the anti-communist mobilisations carried out by Central European representatives in the Parliamentary Assembly of the Council of Europe and in the European Parliament since the early 1990s. Based on archive consultation, interviews and ethnographic observation, it analyses the memory entrepreneurs’ requests for collective remembrance and legal accountability of Communist crimes in European institutions, Pan-European political parties and transnational advocacy networks. The book argues that these newcomers managed to strengthen their positions and impose a totalitarian interpretation of Communism in the European assemblies, which directly shaped the EU’s remembrance policy. However, the rules of the European political game and recurring ideological conflicts with left-wing opponents reduced the legal and judicial implications of this anti-communist grammar at the European level. This text will be of key interest to scholars and graduate students in memory studies, post-Communist politics and European studies, and more broadly in history, political science and sociology.

Looking at the factors that led up to criminalization, Benjamin Gonzalez O’Brien points to the alternative approach of the Immigration Reform and Control Act of 1986 and how its ultimate demise served to negatively reinforce the fictitious association of extralegal immigrants with criminality. Crucial to Gonzalez O’Brien’s account thus is the concept of the critical policy failure—a piece of legislation that attempts a radically different approach to a major issue but has shortcomings that ultimately further entrench the approach it was designed to supplant. The IRCA was just such a piece of legislation. It highlighted the contributions of the undocumented and offered amnesty to some while attempting to stem the flow of extralegal immigration by holding employers accountable for hiring the undocumented. The failure of this effort at decriminalization prompted a return to criminalization with a vengeance, leading to the stalemate on immigration policy that persists to this day.

Book excerpt: We study the role of crime and money in elections and politics in the context of several recent far reaching judgments of the Supreme Court and the Central Information Commission. Based on publicly available data of over 62,800 candidates who contested National and State Assembly elections from 2004 to 2013, we show that both crime and money play an important role in winning elections. Thus average assets go up from Rs.1.37 crore per candidate to Rs.2.03 crores for third place candidates, Rs.2.47 crores for runners up, Rs.3.8 crore for winners, Rs.4.27 crore for winners with some criminal record, and Rs.4.4 crore for winners with serious criminal records. About 30% of elected representatives in Lok Sabha and State Assemblies have criminal cases against them. Similarly, while only 12% of 'clean' candidates without any criminal record win, 23% of those with a criminal record, and again, 23% of those with serious criminal records win. Several candidates and winners have multiple cases, and on average there is 1 serious case for every 5 candidates and 1 for every 2 winners. Women candidates and representatives clearly show a much lower level of criminal records. With rising inequality, proliferation of political parties leading to winners with smaller percentages of the votes, and the role of big money in elections, votes can be easily 'bought'. We end with some tentative recommendations for improving the situation. These include legal, and administrative changes, and the role that civil society and voters can play. We look at options of moving beyond the current first past the post 'British' system to other systems including the American Presidential system, the European proportional representation system, the French style run-off elections and the Japanese system of multi member constituencies. Immediate electoral political considerations might promote ad hoc changes that would lead us astray. A long public debate and discussion is needed to try and evolve a reasonable consensus.
