Yet, corporations are not traditional objects of criminal law. Justified by notions of personal moral guilt, criminal norms have been judged inapplicable to fictional persons, who ‘think’ and ‘act’ through human beings. The expansion of new corporate criminal liability (CCL) laws since the mid-1990s challenges this assumption. Our volume surveys current practice on CCL in 15 civil and common law jurisdictions, exploring the legal conditions for liability, the principles and options for sanctioning, and the procedures for investigating, charging and trying corporate offenders. It considers whether municipal CCL laws are converging around the notion of ‘corporate culture’, and, in any case, the implications of CCL for those charged with keeping corporations, and other legal entities, out of trouble.

Book excerpt: As shown by the trials of Slobodan Milosevic, Charles Taylor and Saddam Hussein, the large-scale and systematic commission of international crimes is usually planned and set in motion by senior political and military leaders. Nevertheless, the application of traditional forms of criminal liability leads to the conclusion that they are mere accessories to such crimes. This does not reflect their central role and often results in a punishment which is inappropriately low in view of the impact of their actions and omissions. For these reasons, international criminal law has placed special emphasis on the development of concepts, such as control of the crime and joint criminal enterprise (also known as the common purpose doctrine), which aim at reflecting better the central role played by senior political and military leaders in campaigns of large scale and systematic commission of international crimes. The Rome Statute of the International Criminal Court and the case law of the ICTY and the ICTR have, in recent years, played a unique role in the achievement of this goal.

Además, se incluyen iniciativas de mejora elaboradas a partir del estudio de buenas prácticas en la respuesta italiana, país que cuenta con una mayor experiencia en su represión debido a la tradicional presencia de la mafia. Estas propuestas incluyen la adopción de medidas de tipo legal que refuercen las fórmulas de éxito en la lucha contra el crimen organizado, de tipo económico y empresarial que consideren la doble victimización de los empresarios, y de la que se deriva la idea de proteger tanto a las personas como a sus negocios, y de tipo social promoviendo la cultura de la legalidad mediante la resistencia empresarial en bloque y la implicación de la sociedad civil en el apoyo a quienes rechacen las exigencias extorsivas. La extorsión a empresas por parte del crimen organizado ha sido el objeto de investigación del proyecto europeo CEREU (Countering Extortion Racketeering in the EU) cofinanciado por la Comisión Europea del que la autora formó parte, y también el tema central de su tesis doctoral, dentro del programa de Derecho, Gobierno y Políticas Públicas de la Facultad de Derecho de la Universidad Autónoma de Madrid.

El auge del sistema capitalista y de libre mercado, la apertura en Europa de las fronteras entre países, y la denominada “revolución tecnológica”, han sido circunstancias aprovechadas por las tradicionales bandas criminales, circunscritas originariamente en su actuación a concretos territorios y actividades delictivas, para fortalecerse y ampliar exponencialmente su campo de actuación, tanto en un sentido espacial como material. Conscientes de la insuficiencia de una lucha articulada exclusivamente a nivel nacional contra un fenómeno tan preocupante y que traspasa las fronteras de los países, las Naciones Unidas y el Consejo de la Unión Europea han dispuesto, entre otras medidas, la obligación de los Estados de incriminar en sus legislaciones la participación en agrupaciones estructuradas para delinquir. Los delitos de organización y grupo criminal, introducidos en el Código penal por la LO 5/2010, de 22 de junio, parecen ser la plasmación de dichos compromisos internacionales en España. Si bien es cierto que ya desde la aprobación de nuestro Código penal se contaba con una figura en principio viable para hacer frente a la delincuencia organizada común, como lo es la aún vigente asociación ilícita de los arts. 515 y ss. CP, su configuración como abuso del derecho de asociación y su historia, vinculada a la represión de la disidencia política, hacen de ella según el legislador un instrumento poco adecuado para este fin. En el presente trabajo se realiza un análisis dogmático y político-criminal de los delitos de organización y el grupo criminal de los arts. 570 bis-570 quáter CP con la pretensión de aclarar cuestiones que resultan hoy controvertidas: la identificación de un contenido de injusto que legitime la incriminación de las conductas típicas -pertenecer, participar, organizar, etc.-, en cuanto anteriores a la ejecución de delitos en el marco de la agrupación delictiva; la delimitación de la conspiración para delinquir con el grupo criminal, y a la vez de este con la organización criminal; o, en fin, el grado de vinculación necesaria con la agrupación para responder como autor de estos delitos.
