Book excerpt: "The International Criminal Tribunal for the former Yugoslavia (ICTY) struggled to apprehend and try high-profile defendants like the Serbian leader Slobodan Milošević, and often received more criticism than praise. This volume argues that the underappreciated court has in fact made a substantial contribution to Bosnia and Herzegovina's transition to democracy. Based on more than three years of field research and several hundred interviews, this study brings together multiple research methods, including surveys, ethnography, and archival materials, to show the court's impact on five segments of Bosnian society, emphasizing the role of the social setting in translating international law in domestic contexts. Much of the early rhetoric about the transformative potential of international criminal law helped foster unrealistic expectations that institutions like the ICTY could not meet, but judged by more realistic standards, international law is seen to play a modest yet important role in postwar transitions. The findings of this study have implications for the study of international courts around the world and the role law plays in contributing to social change"--

Political problems are increasingly complex and technical in nature, and the democratic process is perceived as making little difference to their solution. The mass media contribute to this development by superficial reporting which encourages the public to regard politics as a kind of "spectator sport". The most effective remedy must be to involve citizens themselves in policy development and decision making on issues which they understand. Such issues are easiest to identify at local level and involvement can most readily be organised within the local community. This guide was designed as an awareness-raising and training tool for local politicians and staff, NGO activists and ordinary citizens, national associations of local authorities and training providers in Bosnia-Herzegovina and Serbia-Montenegro.

Book excerpt: The right to be elected, although an important political right guaranteed in human rights documents on international and regional levels, is still an under-researched and undertheorized concept with many synonyms in use. While the right to vote is often correlated with democracy, the closely related right to be elected is often neglected, and the constitutions of most countries are silent about it. The 2009 European Court of Human Rights (ECtHR) decision in the case of Sejdić and Finci v. Bosnia and Herzegovina started the discussions concerning the discrimination in enjoyment of the right to be elected in Bosnia and Herzegovina. Although the right to be elected is not explicitly guaranteed in the Dayton Constitution but only in the Law on Election, the ECtHR considered equal enjoyment of this right by everyone in Bosnia and Herzegovina of high importance and declared the relevant Dayton Constitution’s provisions discriminatory. The book explains the conceptual relevance of the right to be elected, its interrelatedness with the right to vote and both these rights’ significance for democratic systems. Through analyzing and explaining the regional human rights tribunal’s decisions concerning the right to be elected, the importance of this political right is elucidated.

Book excerpt: Previously published as a special issue of Ethnopolitics, this volume analyzes various dimensions of the internationalized state-building process in Bosnia and Herzegovina since 1995. In December 1995, the Dayton Agreements ended the war in Bosnia and Herzegovina and established a fragile peace between the former conflict parties. The settlement seemed morally wrong and politically impracticable, but still necessary in order to end violence of a scale and intensity not seen in Europe since the end of the Second World War. The leading contributors conclude that internationalized state-building can only serve well in the stabilization of states emerging from conflict if it draws on a well-balanced approach of consociational techniques, moderated by integrative policies, tempered by a wider regional outlook and sustained by resourceful and skilled international involvement. The experience of Bosnia and Herzegovina may not have scored full marks in all of these categories, but important lessons can be gleaned for other similar contemporary and future challenges that the international community no doubt will have to face.
