Book excerpt: Since the 9/11 attacks the world has witnessed the creation of both domestic and international legal instruments designed to disrupt and interdict the financial activities of terrorists. This book analyses the counter-terrorist financing law (CTF), policy and practice at the national level, focusing on Turkey. The work examines the limits and capabilities of CTF efforts on terrorism threats and determines the effectiveness of CTF efforts in Turkey, a country which has a pivotal role in terms of countering terrorism regionally and internationally. The Turkish case-study is supported by an empirical study involving 37 semi-structured interviews with CTF practitioners and law enforcement experts with different affiliations and backgrounds. The findings illustrate that Turkey’s CTF system has not obtained an adequate level of effectiveness as a result of lack of proper implementation of its policy in the bureaucratic, legal and operational spheres. It is evident that the administrative and legal systems in Turkey are established according to the ‘one-size-fits-all’ international CTF standards and thus are compliant with the international CTF benchmarks, yet the interviews reveal significant challenges at the implementation level including lack of training and financial security, heavy handed bureaucracy, inadequate coordination and communication between international and national levels. Book excerpt: Confronting the multiple national security threats facing the world today demands not only close international cooperation but also coordinated national strategies that employ all elements of national power. Such a strategy recognizes that no one specific tool will deter, disrupt or prevent the illicit activities of terrorists, proliferators, insurgents, organized criminals or other transnational threats, and that employing a variety of instruments in a coordinated fashion is likely to produce the best results. However, one tool that shows particular promise, especially when used in concert with other policy tools, is combating the financing of transnational threats. Combating illicit financing can be effective, depending on the target, at three levels: deterrence, prevention and disruption. Freezing terrorist funds, for example, has a deterrent effect on major donors, pressing financiers to rethink their support because of the potential hindrance to their day-to-day business activities. Countering terrorist financing will not dry up all the funding available to terrorists, but it is an effective and efficient means of constricting our adversaries’ operating environment by making it difficult to fund illicit activities. The financial sector provides reliable and substantive intelligence to investigators tracing money both upstream and downstream, from funding sources to potential operators. Following the “money trail” enables authorities to thwart attacks, and despite the difficulty of permanently disabling terrorist entities, disrupting their financial transactions constrains their ability to function. Weapons proliferation, especially in the area of missile technology and weapons of mass destruction (WMD), is extremely expensive. Similarly, insurgencies require significant funding, as do organized terrorist groups, which require extensive resources to train, equip and pay operatives; bribe officials; support members’ families; secure materials; and publicly promote their cause. Since even inexpensive attacks require funding, small-scale interventions can effectively thwart terrorists if they are unable to access necessary funds when and where they need them. Since the 9/11 attacks the terrorist threat has evolved structurally and financially. Globalization has exponentially increased the flow of transactions through the international financial system, in part making it easier to conduct illicit transactions in plain sight.

Targeting Terrorist Financing argues that it is not the institutions that have failed the war on terrorist financing; rather it is the states that have failed the institutions. The measures contemplated by the world community to interdict terrorists and their financial infrastructures are sufficient to debilitate the terrorists both militarily and financially. However, what has been increasingly lacking is political will among the states, and this has overwhelmed the spirit of cooperation in this very critical front against terrorism. This volume assesses the need for international cooperation and the role of institutions and regimes in targeting terrorist financing. After the 9/11 attacks, there was an expression of global willingness to target terrorism generally, and terrorist financing in particular. The institutional mechanisms that grew out of this are explored in detail here, with a critical examination of the progress made by the international community. The impact of these measures is considered with respect to changes in the nature of the terrorist threat, money confiscated, adoption of international conventions, and global standards by states, and levels of compliance, among others.
