It delves into their posture of resistance to critically examine how their perspective has gradually changed and how they have adapted and molded their investment agreements so as not to leave their position as players in the field of International Investment Law. Many Latin American states have appeared as defendants before international investment tribunals and some of these, like Venezuela, Bolivia or Ecuador, have denounced their international investment agreements. Deeming the law field as imbalanced, they have looked for alternatives to continue providing legal protection to foreign investors while protecting their right to regulate in the name of public interest. Some interesting investment agreements models, sometimes of a different ilk, have consequently flourished and have arrested the attention of those studying or working with international investment law. The main objective of this book is to critically discuss how Latin American states have accepted, resisted, or adapted themselves to international investment law and arbitration. Accordingly, the general connection between these states and international investment law are explained in an introduction which examines the general trends as per which Latin American states have offered a legal protection to foreign investments. The first part enters the merits of where international investment law and arbitration stand in some Latin American states whereby the experience of Brazil, Chile, Argentina, Venezuela, and Uruguay are discussed. The following parts explain the trends in international investment law and arbitration in Latin America. These trends are namely related to dispute settlement and governance, to the connection between investment law and human rights and finally to regionalization. Book excerpt: In this volume, Latin Americanist scholars explore the recent evidence relating to the ways in which partial state failure in the continent is interacting with new types of organized violence, thereby undermining the process of democratic consolidation that has characterized Latin America over the past two decades. This 'new violence' stems - as this book's case studies from Colombia, Peru, Argentina, Venezuela, Brazil and other countries, including El Salvador, show - from a heterogeneous variety of social actors including drug mafias, peasant militias and urban gangs (collectively referred to as actores armadas), as well as state-related actors like the police, military intelligence agencies and paramilitary forces. These armed actors are reproducing organized social and political violence beyond the confines of democratic politics and civil society. The results, as the authors warn, include both 'governance voids' - domains where the legitimate state is effectively absent in the face of armed actors prevailing by force - and an erosion of the capacity and willingness of state officials themselves to abide by the rule of law. These tendencies, in turn, pave the way for a possible reinstallation of authoritarian regimes under the control of politicized armies or, at the very least, the spread of state violence in one form or another. Why these tendencies need to be taken so seriously is, the authors argue, because of the deeper social roots underlying them - notably the failure of neoliberal economic policies and weakened state structures to deliver the jobs, standards of living and social services every democratic citizenry has a right to expect. The Argentinian collapse and persistent Colombian and Venezuelan crises receive special attention in this regard.

En El Salvador y en Colombia, aunque se celebraron en tiempos distintos, ambos tipos de comicios se consideran en el mismo capítulo; allí, las presidenciales precedieron a las legislativas con un año de diferencia en el primer país y las legislativas antecedieron por tres meses a las presidenciales en el segundo. Se recogen también en capítulos independientes las elecciones únicamente legislativas de México y Venezuela. Si bien el criterio temporal siempre puede calificarse de caprichoso en este caso sigue la preocupación iniciada hace ocho años de dar cumplida cuenta del acontecer electoral en la región, en el ámbito de los dos poderes representativos del Estado por excelencia.
