Book excerpt: Trade in services, far more than trade in goods, is affected by a variety of domestic regulations, ranging from qualification and licensing requirements in professional services to pro-competitive regulation in telecommunications services. Experience shows that the quality of regulation strongly influences the consequences of trade liberalization. WTO members have agreed that a central task in the ongoing services negotiations will be to develop a set of rules to ensure that domestic regulations support rather than impede trade liberalization. Since these rules are bound to have a profound impact on the evolution of policy, particularly in developing countries, it is important that they be conducive to economically rational policy-making. This book addresses two central questions: What impact can international trade rules on services have on the exercise of domestic regulatory sovereignty? And how can services negotiations be harnessed to promote and consolidate domestic policy reform across highly diverse sectors? Although this conception has been challenged in recent years, it has not been completely dispelled. In Colour-Coded, Constance Backhouse illustrates the tenacious hold that white supremacy had on our legal system in the first half of this century, and underscores the damaging legacy of inequality that continues today. Backhouse presents detailed narratives of six court cases, each giving evidence of blatant racism created and enforced through law. The cases focus on Aboriginal, Inuit, Chinese-Canadian, and African-Canadian individuals, taking us from the criminal prosecution of traditional Aboriginal dance to the trial of members of the 'Ku Klux Klan of Kanada.' From thousands of possibilities, Backhouse has selected studies that constitute central moments in the legal history of race in Canada. Her selection also considers a wide range of legal forums, including administrative rulings by municipal councils, criminal trials before police magistrates, and criminal and civil cases heard by the highest courts in the provinces and by the Supreme Court of Canada. Book excerpt: Nearly 40 years after the concept of finite deterrence was popularized by the Johnson administration, nuclear Mutual Assured Destruction (MAD) thinking appears to be in decline. The United States has rejected the notion that threatening population centers with nuclear attacks is a legitimate way to assure deterrence. Most recently, it withdrew from the Anti-Ballistic Missile Treaty, an agreement based on MAD. American opposition to MAD also is reflected in the Bush administration's desire to develop smaller, more accurate nuclear weapons that would reduce the number of innocent civilians killed in a nuclear strike. Still, MAD is influential in a number of ways. First, other countries, like China, have not abandoned the idea that holding their adversaries' cities at risk is necessary to assure their own strategic security. Nor have U.S. and allied security officials and experts fully abandoned the idea. At a minimum, acquiring nuclear weapons is still viewed as being sensible to face off a hostile neighbor that might strike one's own cities. Thus, our diplomats have been warning China that Japan would be under tremendous pressure to go nuclear if North Korea persisted in acquiring a few crude weapons of its own. Similarly, Israeli officials have long argued, without criticism, that they would not be second in acquiring nuclear weapons in the Middle East. Indeed, given that Israelis surrounded by enemies that would not hesitate to destroy its population if they could, Washington finds Israel's retention of a significant nuclear capability totally "understandable."
