Book Theory and Practice of Transboundary Environmental Impact Assessment

Download or read book Theory and Practice of Transboundary Environmental Impact Assessment written by C.J. Bastmeijer and published by BRILL. This book was released on 2007-12-31 with total page 424 pages. Available in PDF, EPUB and Kindle. Book excerpt: Environmental Impact Assessment (EIA) is a well-established instrument of Environmental Law and policy that aims to ensure that potential adverse environmental effects of human activities are assessed before decisions on such activities are made. The instrument is increasingly being applied in respect of activities that may cause environmental effects across the borders of a state. In this book, thirteen systems of Transboundary Environmental Impact Assessment (TEIA) are assessed that exist or are in development in different parts of the world. Although TEIA is generally associated with EIA between territorial states, this book takes a broader approach and is divided into three sub-parts: Transboundary EIA between states, EIA for activities in international and shared areas, and EIA required by international financial institutions. Knowledgeable experts (scholars and practitioners) provide an overview of the history, content, and practice of the individual systems and, based on these discussions, the state of the art concerning TEIA and possible future developments are discussed.

Book Responsibility and Liability in the Context of Transboundary Movements of Hazardous Wastes by Sea

Download or read book Responsibility and Liability in the Context of Transboundary Movements of Hazardous Wastes by Sea written by Jan Albers and published by Springer. This book was released on 2014-09-25 with total page 389 pages. Available in PDF, EPUB and Kindle. Book excerpt: The term “hazardous wastes” covers a wide range of disused products and production wastes generated not only in industrial sectors, but also in all areas of everyday life. Hazardous wastes are to a large extent shipped by sea to third countries for recycling or disposal. While the procedural requirements for such movements are laid out in the 1989 Basel Convention, explicit rules of responsibility and liability for resulting damages are neither provided by the Basel Convention nor by other international conventions. The Liability Protocol to the Basel Convention of 1999 has not yet entered into force. This book examines the existing rules of responsibility and liability applying to States and private persons and outlines the conditions under which liability may be incurred. Subsequently, the advantages and shortcomings of the 1999 Liability Protocol are analyzed. Although this Protocol faces substantial political headwind, from a legal perspective it includes principally useful and reasonable approaches and should therefore be ratified.

Book Turkey s Water Policy

Download or read book Turkey s Water Policy written by Aysegul Kibaroglu and published by Springer Science & Business Media. This book was released on 2011-08-19 with total page 426 pages. Available in PDF, EPUB and Kindle. Book excerpt: Water is a strategic natural resource of vital importance to all nations. As such it has been the cause of several international disputes. For Turkey especially, water is crucial to social and economic development. Turkey’s current national water regime that emphasises water resources development and management for productive uses, however, faces growing environmental concerns and international criticism regarding transboundary water cooperation. Furthermore, EU accession requires Turkey to adopt an extensive and ambitious body of EU water law. To understand Turkey’s position to international water law, the national policies and socio-economic circumstances that impact water resources management need to be considered. This book fills the existing knowledge gap through a broad perspective and analysis of the current state of Turkey’s water policy and its management of both national and transboundary waters. It is a unique undertaking that brings together Turkish and international authors, practitioners and academics, covering all aspects of water management

Book Making Treaties Work

Download or read book Making Treaties Work written by Geir Ulfstein and published by Cambridge University Press. This book was released on 2007-04-12 with total page 36 pages. Available in PDF, EPUB and Kindle. Book excerpt: There is an increasing focus on the need for national implementation of treaties. International law has traditionally left enforcement to the individual parties, but more and more treaties contain arrangements to induce States to comply with their commitments. Experts in this 2007 book examine three forms of such mechanisms: dispute settlement procedures in the form of international courts, non-compliance procedures of an administrative character, and enforcement of obligation by coercive means. Three fields are examined, namely human rights, international environmental law, and arms control and disarmament. These areas are in the forefront of the development of international law and deal with multilateral, rather than purely bilateral issues. Each part of the book on human rights, international environmental law and arms control contain a general introduction and case studies of the relevant treaties in the field. Will appeal widely to both generalists and specialists in international law and relations.

Book Industrial Disasters Toxic Waste and Community Impact

Download or read book Industrial Disasters Toxic Waste and Community Impact written by Francis O. Adeola and published by Lexington Books. This book was released on 2012-09-27 with total page 315 pages. Available in PDF, EPUB and Kindle. Book excerpt: Industrial Disasters, Toxic Waste, and Community Impact focuses on hazardous and toxic wastes releases, industrial disasters, the consequent contamination of communities and the environment, and the subsequent social impacts, including adverse health effects, deaths and property destruction, psychosocial problems, and community disruption. This book explains the emergence of a sociological study of risk and of natural, technological, and hybrid disasters, along with a review of the accumulated body of knowledge in the field. It is unique in its integration of sociological perspectives with perspectives from other disciplines when discussing the problems posed by technological hazards both in advanced industrialized societies and in the underdeveloped world. Francis O. Adeola extends the field through an innovative presentation of topics which up to now have had sparse treatment in sociology texts. This book starts by presenting the sociology of hazardous waste, risk, and disasters as a relatively new development, engendering both a growing passion and an increasing volume of empirical research among scholars. Next, it describes how hazardous and toxic wastes disposal, exposure, remediation, and proximate adverse health consequences have risen to the level of endemic social problem both in the United States and around the world. After discussing these cases in relation to contemporary theories of industrial and organizational disasters, Adeola delves into classifying of hazardous wastes, indicating the characteristics of each type of waste, and identifying what makes them especially dangerous to people and the environment. Other major topics addressed in the rest of the book include electronic waste (e-waste) as a new species of trouble in terms of the volume and toxicity of global e-waste generation and management, the environmental and health risks of Persistent Organic Pollutants (POPs), case studies of contaminated communities within the United States and across the globe, the international flows of toxic waste, analysis of risk and environmental contamination by race and ethnicity in the United States, and the juxtaposition of the issues of environmental justice and human rights. With its many contributions to environmental sociology, Industrial Disasters, Toxic Waste, and Community Impact will be a valuable addition to the libraries of students, scholars, and practitioners interested in the intersection of toxic waste releases, human exposure to contaminants, and public health.

The Handbook discusses the key principles underpinning international environmental law, its relevant actors and tools, and rules applying in its substantive sub-fields such as climate law, oceans law, wildlife and biodiversity law, and hazardous substances regulation. It also explores the intersection of international environmental law with other areas of international law, such as those concerned with trade, investment, disaster, migration, armed conflict, intellectual property, energy, and human rights. The Handbook sets its discussion of international environmental law in the broader interdisciplinary context of developments in science, ethics, politics and economics, which inform the way in which environmental rules are made, implemented, and enforced. It provides an introduction to the foundations of international environmental law while also engaging with questions at the frontiers of research, teaching, and practice in the field, including the role of Global South perspectives, the contribution made by Earth jurisprudence, and the growing role of a diverse range of actors from indigenous peoples to business and industry. Like the first edition, this second edition of the Handbook is an essential reference text for all engaged with environmental issues at the international level and the applicable governance and regulatory structures.
