El planteamiento de este trabajo parte de la distinción entre las que denominaremos vertiente preventiva del control y vertiente correctiva del control, para centrarnos, a continuación, en la segunda vertiente. Desde esa perspectiva, se observará que el control administrativo constituye una función administrativa que goza de unidad estructural, lo que no es incompatible con una gran flexibilidad. En este sentido, la función administrativa de control goza de una variabilidad caracterizadora en la que nuestro Derecho está mostrando una gran versatilidad. Algunos de esos ejemplos son analizados en este trabajo. Este trabajo también cuestiona si cualquier mecanismo de control administrativo es válido para formar parte de un sistema constitucional orientado a la provisión de justicia. El control administrativo puede ser un elemento esencial de ese sistema, pero mantener esta afirmación requiere justificar tres cuestiones que son abordadas en este libro. En primer lugar, que no existe ningún mandato constitucional que imponga que la provisión de justicia deba lograrse únicamente mediante la maximización del control que garantiza el control judicial. Segundo, que proveer justicia exige dotar a la función administrativa de control de una especial caracterización jurídica; aquí, las experiencias y la jurisprudencia comparada y europea son una base comparativa fundamental. Tercero, y no menos importante, el planteamiento de un sistema de justicia administrativa integrador, exige preguntarse por los problemas de la Jurisdicción Contencioso-administrativa; sólo conociendo esa realidad jurídica será posible formular propuestas en las que los mecanismos de control administrativo puedan complementar con efectividad la función jurisdiccional. Book excerpt: The aim of the book is to resolve the question of whether multiple sanctioning systems are contrary to the ne bis in idem under the regulation provided by Protocol 7 to the ECHR and the EU Charter of Fundamental Rights. The first part is a comparative study regarding the lawfulness of multiple sanctioning systems under the ne bis in idem, studying the evolution and the current state of the case law of the United States Supreme Court, the Canadian Supreme Court, the European Court of Human Rights (ECtHR), and the Court of Justice of the European Union (CJEU). The second part of the book critically analyses three problems with the case law of the ECtHR and the CJEU. Part three deals with reconceptualizing the prohibition of multiple punishment and the prohibition of multiple prosecutions. Finally, the fourth part addresses other possible protections against multiple sanctioning systems. Two other safeguards that limit multiple sanctioning systems are the prohibition of disproportionate sanctions and the right to be tried within a reasonable time.
