La victime y trouve un statut équilibré, tandis que le lien social se déplace vers l'assurance.

Book excerpt: Les principes généraux qui gouvernent le droit de la responsabilité médicale pour faute, sont fortement similaires en droit français et en droit américain et ce, malgré des fondements juridiques différents. Droit romano-germanique et common law tendent ainsi à se rapprocher concernant le régime de la responsabilité. Dans les deux législations pourtant, la relation médicale est mise à mal. En France, la dégradation du climat de confiance entre un médecin et son patient peut être perçue comme une américanisation du droit de la responsabilité médicale. Cette détérioration se manifeste notamment par l'apparition d'un phénomène de judiciarisation de l'activité médicale, d'une pratique de la médecine défensive et d'une crise de l'assurance responsabilité civile médicale. Le patient est devenu plus qu'un consommateur de soins, il exige un résultat dont la seule absence le conduit à se positionner en tant que victime. Mais faut-il vraiment craindre cette influence venue d'outre atlantique ? Nous pensons en effet que l'adoption de certains principes de la common law pourrait créer un nouvel équilibre dans la relation de soins. Ainsi, les class actions, les dommages et intérêts punitifs, le principe de la mitigation ou l'introduction systématique des modes alternatifs de règlements des conflits pourraient participer au renforcement de cette relation.

Book excerpt: The Association Henri Capitant des Amis de la Culture Juridique Française and the Société de législation comparée joined the academic network on European Contract Law in 2005 to work on the elaboration of a "common terminology" and on "guiding principles" as well as to propose a revised version of the Principles of European Contract Law (PECL). The results of this work were sent to the European Commission and have already been published in French. The English translation is now being published by sellier.elp. This work could contribute to the wider European project. The part on the guiding principles could be a component of the CFR, in the form of "black letter" model rules or recitals. The part on terminology is, in itself, useful for the elaboration of the final various linguistic versions of the CFR. It finds its place within the materials which will accompany the model rules. Last but by no means least, the revised version of the PECL should be considered by the European institutions as an alternative set of model rules on contract law.
