Este libro no se ocupa de esta materia, en constante movimiento, que exige actualización de las publicaciones y que las hace muy perecederas. El autor recoge aquí artículos publicados a nivel nacional e internacional en los últimos 10 años sobre temas contractuales, distintos de los procedimientos de contratación que plantean tendencias de la contratación y análisis sobre instituciones que perduran por encima de las modificaciones normativas. De este modo son abordadas las tendencias e influencia creciente del derecho internacional, así como otras fuentes del derecho contractual, mediante el análisis de la viabilidad de un verdadero estatuto único de contratación, el espacio de la reglamentación de los contratos públicos, el carácter particular de los pliegos de condiciones, la valoración del principio de eficacia y el análisis crítico del enriquecimiento sin causa. El autor también propone análisis de aspectos que han sido particularmente polémicos en el desarrollo doctrinal y jurisprudencial, como la delimitación del contrato de prestación de servicios frente al principio constitucional laboral del contrato realidad, la caracterización y alcances de la adición de contratos o las concepciones sobre la imprevisión, como manifestación del reequilibrio contractual. Los artículos recopilados en esta publicación no constituyen su reproducción original, sino que han sido objeto de una cuidadosa actualización con la jurisprudencia más reciente y la renovada reglamentación en materia de contratación pública. El interés por el análisis de instituciones contractuales se ve así renovado en su tratamiento actual.
