Cette première partie permet d'appréhender les développements récents de la théorie de la responsabilité délictuelle et contractuelle concernant les actions en justice introduites par le contractant évincé ayant subi un préjudice. Dans un second temps, lè contrat de distribution est examiné au prisme du droit international privé français et brésilien. A travers l'étude de la détermination de la juridiction compétente - tant étatique qu'arbitrale - et du droit applicable, l'auteur montre que le traitement de la rupture brutale du contrat de distribution en droit interne et international dépend amplement des objectifs poursuivis par 1e législateur et les tribunaux lors de l'application du droit.
