De sorte qu'il est devenu désuet et quelque peu incorrect de soutenir qu'il n'existe que trois formes d'affrètement. L'imagination de la pratique est sans limites en la matière. Les formes traditionnellement connues font parfois l'objet d'aménagements. Il en résulte des contrats d'affrètement à temps pour un voyage et de l'affrètement au voyage pour une période de temps déterminée. Une vision prospective de l'affrètement d'espaces conduit à se demander si l'avenir ne résidera pas dans la répartition entre affrètement ponctuels et affrètements structurels. Seuls les professionnels nous le diront. Pour les juristes, les récents développements bouleversent les certitudes et repoussent les frontières juridiques et invitent à faire preuve d'originalité, aussi bien sur l'approche de la qualification juridique de chacune des figures contractuelles, que sur les aspects d'identification de la qualité des parties. Ils soulèvent également les difficultés quant à la détermination du régime de responsabilité qu'il convient d'appliquer entre les parties d'une part, et à l'égard des tiers d'autre part. Doit-on appliquer un régime autonome ou hybride face à la démultiplication de contrats? C'est tout l'intérêt que suscite le thème du contrat d'affrètement maritime, ses évolutions et ses perspectives.
