Download or read book Contentieux du droit de la concurrence de l Union europ enne written by Valérie Giacobbo Peyronnel and published by Bruylant. This book was released on 2017-03-16 with total page 586 pages. Available in PDF, EPUB and Kindle.

Download or read book Droit de la concurrence Libert s de circulation 6e d written by Cyril Nourissat and published by Dalloz. This book was released on 2020-09-02 with total page 767 pages. Available in PDF, EPUB and Kindle.

Available in PDF, EPUB and Kindle.

Download or read book Droit europ en de la concurrence written by Catherine Prieto and published by Emile Bruylant. This book was released on 2013 with total page 1520 pages. Available in PDF, EPUB and Kindle.

Download or read book The Constitution of France written by Sophie Boyron and published by Bloomsbury Publishing. This book was released on 2012-12-21 with total page 290 pages. Available in PDF, EPUB and Kindle. Book excerpt: The centrepiece of this work is the French Constitution of 1958, portrayed by the author as an innovative hybrid construct whose arrival brought the constitutional stability that had eluded France for centuries. But the creation of the 1958 Constitution was not an isolated act; it represents part of an evolutionary process which continues to this day. Even though it is codified, the constitution of the Fifth Republic has evolved so markedly that some commentators have dubbed the present institutional balance the 'Sixth Republic'. It is this dynamic of the constitution which this book seeks to explain. At the same time the book shows how the French constitution has not developed in isolation, but reflects to some extent the global movement of ideas, ideas which sometimes challenge the very foundations of the 1958 Constitution.

Book Forum Shopping in the European Judicial Area

Download or read book Forum Shopping in the European Judicial Area written by Pascal de Vareilles-Sommières and published by Bloomsbury Publishing. This book was released on 2007-12-18 with total page 260 pages. Available in PDF, EPUB and Kindle. Book excerpt: One of the issues left untouched by the Brussels Convention of 27 September 1968 (and by the Brussels-1 Regulation replacing it) concerns the leeway left to domestic courts when applying European rules on international jurisdiction in civil and commercial matters. For instance, is the court under a duty of strict compliance with the jurisdiction rule as it is drafted? Would such a duty go so far as to require the court to abide by the jurisdiction rule, even though it is being used by one of the litigants to achieve an unfair result, for example to delay adjudication on the merits? Under what conditions may the Court decline jurisdiction on account of any unsuitable forum shopping, thus ruling out the European provision on jurisdiction? Recent litigation in the ECJ has yielded rather, even excessively, restrictive answers, ruling out any discretion by domestic courts to remedy any inconvenience arising from the strict application of the European provisions, if such discretion were provided for by the lex fori (the Gasser case, the Turner case, and the Owusu case). This series of rulings from the ECJ raises several questions. Most observers have questioned the appropriateness of prescribing a blind application of European rules on jurisdiction by domestic courts, relying on the legal traditions of EC Member States usually providing for corrective mechanisms - such as 'forum non conveniens' in English Law and 'exception de fraude' in French Law - in cases when a party abusively triggers the jurisdiction of a court in order to obtain an unjust advantage, thus practising unacceptable forum shopping. The time has now come for an analysis, under both Community and comparative law, of the ramifications of the recent Gasser/Turner/Owusu cases. Readers will find in this book a collection of studies by some of the leading English and French experts today, analysing the ins and outs of jurisdiction and forum shopping in Europe.

Book The Rule of Law in International Affairs

Download or read book The Rule of Law in International Affairs written by Ian Brownlie and published by Martinus Nijhoff Publishers. This book was released on 1998-08-26 with total page 264 pages. Available in PDF, EPUB and Kindle. Book excerpt: This volume consists of a carefully edited version of the General Course on Public International Law delivered at the Hague Academy of International Law to commemorate the fiftieth anniversary of the foundation of the United Nations. The author brings to them not only his background of academic distinction, but his experience as a practitioner concerned with major international legal issues. The rule of law in international affairs is a question of perennial concern but it is of greater moment these days for a number of reasons. The active agenda of the Security Council and its relative solidarity creates a paradox. Its increased political power is a source of hope but the modalities of the exercise of power present problems of principle and of legal concern. Another area of concern is the International Court, which has had a successful record since the early eighties and provides one of the guarantees of the maintenance of legality. Recent successes of the Court include the effective resolution of the territorial dispute between Chad and Libya. The general level of compliance with its decisions by States is impressive. Yet its success is matched not by encouragement and enhancement of its facilities but by United Nations financial constraints which hinder its work and, ultimately, may threaten its independence in relation to the political organs of the United Nations.

Book Africa from the Sixteenth to the Eighteenth Century

Download or read book Africa from the Sixteenth to the Eighteenth Century written by Bethwell A. Ogot and published by Univ of California Press. This book was released on 1992 with total page 1088 pages. Available in PDF, EPUB and Kindle. Book excerpt: The result of years of work by scholars from all over the world, The UNESCO General History of Africa reflects how the different peoples of Africa view their civilizations and shows the historical relationships between the various parts of the continent. Historical connections with other continents demonstrate Africa's contribution to the development of human civilization. Each volume is lavishly illustrated and contains a comprehensive bibliography. This fifth volume of the acclaimed series covers the history of the continent from the beginning of the sixteenth century to the close of the eighteenth century in which two themes emerge: first, the continuing internal evolution of the states and cultures of Africa during this period second, the increasing involvement of Africa in external trade--with major but unforeseen consequences for the whole world. In North Africa, we see the Ottomans conquer Egypt. South of the Sahara, some of the larger, older states collapse, and new power bases emerge. Traditional religions continue to coexist with both Christianity (suffering setbacks) and Islam (in the ascendancy). Along the coast, particularly of West Africa, Europeans establish a trading network which, with the development of New World plantation agriculture, becomes the focus of the international slave trade. The immediate consequences of this trade for Africa are explored, and it is argued that the long-term global consequences include the foundation of the present world-economy with all its built-in inequalities.

Book excerpt: Young people are transforming the global landscape. As the human population today is younger and more urban than ever before, prospects for achieving adulthood dwindle while urban migration soars. Devastated by genocide, hailed as a spectacular success, and critiqued for its human rights record, the Central African nation of Rwanda provides a compelling setting for grasping new challenges to the world's youth. Spotlighting failed masculinity, urban desperation, and forceful governance, Marc Sommers tells the dramatic story of young Rwandans who are “stuck,” striving against near-impossible odds to become adults. In Rwandan culture, female youth must wait, often in vain, for male youth to build a house before they can marry. Only then can male and female youth gain acceptance as adults. However, Rwanda's severe housing crisis means that most male youth are on a treadmill toward failure, unable to build their house yet having no choice but to try. What follows is too often tragic. Rural youth face a future as failed adults, while many who migrate to the capital fail to secure a stable life and turn fatalistic about contracting HIV/AIDS. Featuring insightful interviews with youth, adults, and government officials, Stuck tells the story of an ambitious, controlling government trying to govern an exceptionally young and poor population in a densely populated and rapidly urbanizing country. This pioneering book sheds new light on the struggle to come of age and suggests new pathways toward the attainment of security, development, and coexistence in Africa and beyond.
