Book Flexibility in Modern Business Law

Download or read book Flexibility in Modern Business Law written by Mark Fenwick and published by Springer. This book was released on 2016-01-08 with total page 229 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book brings together a number of contributions examining how changes associated with economic globalization have contributed to the creation of new pressures on, and expectations of, those fields of law connected to the regulation of cross-border commercial transactions. These new demands of law – in particular, that it be more agile or “flexible” in regulating the economy – have prompted lawmakers and regulators in multiple jurisdictions to adopt a range of new regulatory techniques and legal forms to respond to this challenge. In many cases, these adaptations in law have entailed compromising traditional legal principles, such as legal certainty, in favor of empowering regulators with greater discretion than has traditionally been permitted in modern law. This change raises important questions about the meaning of fairness (certainty or flexibility), as well as the relationship between the public and private good.

Book International Business and Economics

Download or read book International Business and Economics written by Paul B. Stephan and published by . This book was released on 2010 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: The First Edition of this text was written at a time when the structures of international relations were undergoing a profound transformation, with the collapse of Soviet-style communism just behind us and the creation of NAFTA and the WTO just ahead. The Second Edition came at a time when NAFTA and the WTO had taken shape but not yet acquired a history. At the time of the Third Edition, both of those structures can be studied in detail and their ramifications for the world economy can be better appreciated. In the interim, the Internet has established itself as a presence in innumerable firms and households, and the dot com bubble has come and gone. The services-oriented information economy seems no longer to be emerging, but rather a fundamental aspect of contemporary business. The Fourth Edition of International Business and Economics reflects the growth and development of the global economy as well as the way law schools prepare lawyers to work in that world. The book was written in the shadow of a financial crisis that seemed at times destined to bring international economic catastrope, but which so far has been grim but not disastrous. The book has been revised more comprehensively than any of the earlier successor editions. For example, materials on international civil litigation have largely dropped out and correspondingly more materials on international investment arbitration and WTO dispute resolution, as well as the interaction between those bodies of law and national law have been added. This book also is available in a three-hole punched, alternative loose-leaf version printed on 8.5 x 11 inch paper with wider margins and with the same pagination as the hardbound book.

Book The Global Business Law

Download or read book The Global Business Law written by Hyungjin Kim and published by Quseum. This book was released on 2020-08-22 with total page 201 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book was motivated by the desire we and others have had to further the evolution of the core course in international legal issues on corporations under current global crisis. As this book is written for students with little legal knowledge, we have done our best to make it simple and easy when we are dealing with legal jargons and theories hoping that this book can be a guiding light to the readers when they want to grasp the very fundamental structure of legal system surrounding today’s corporations in the global market. As the U.S. is a dominant power in the world economy, it is unavoidable and also necessary that this book is focusing on the U.S. perspectives rather than many other countries’ perspectives. We would like to focus more on other countries, especially China, when we publish a revised version of this book later. It has been a great time for us to finish this book after many years of preparation and research. We are of concern that after such a long period of preparation, this book still needs to be improved in many points. We will continue to make every effort to improve the quality of this book from now on. Nevertheless, we are very honored and excited to wrap up this chapter of our lives by introducing this book of the second edition to the world.

Book Tax Sovereignty and the Law in the Digital and Global Economy

Download or read book Tax Sovereignty and the Law in the Digital and Global Economy written by Francesco Farri and published by Routledge. This book was released on 2020-09-27 with total page 249 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book discusses which is the most appropriate tax dimension to best manage the new horizons of the global and digital economy. In this perspective, the efficiency of the main models is examined and two fundamental proposals are put forth: the first one aims at a coordination of the Destination-Based approach with the role of some specific digital assets, such as user data; the second one is a framework for a possible futuristic tax phenomenon all internal to the world of the internet and not linked to traditional territorial States. The compliance of these models with the constitutional principles that western democratic systems have affirmed over time in matters of taxation is then analyzed with particular regard to legal certainty, consent to taxation and to the re-distributive function of taxes. A specific evaluation of the role of the European Union is carried out and the jurisprudence on financial interests of the Union and on State aids is analyzed and tackled in light of the Treaty on the Functioning of the European Union and of the tax sovereignty of member States. The conclusion is that the model of the organization with a general political purpose, from which modern States take their inspiration, appears unfailing for a tax project that would focus on the good and the growth of the person and of the social aggregations in which everyone lives. A model that therefore deserves to be safeguarded, although with new methods and instruments, starting from a Destination-Based Asset-Coordinated approach, in the Third Millennium. The book will be of interest to researchers and academics in international tax law, constitutional law and in political science.

Book Business and Society

Download or read book Business and Society written by Sonya Scott and published by Bloomsbury Publishing. This book was released on 2023-08-10 with total page 441 pages. Available in PDF, EPUB and Kindle. Book excerpt: Corporations dominate our worlds. They employ us, sell to us and influence how we think and who we vote for. All aspects of this relationship are explored, from an historical analysis of the spread of capitalism to the regulation, ethics and exclusionary implications of business in contemporary society. The book also examines how corporate power and capitalism might be resisted and outlines a range of alternatives, from the social economy through to new forms of open access or commons ownership. This second edition includes new chapters that explore how global crises such as the Covid-19 pandemic and the climate emergency have exposed tensions within and among national business systems. It also addresses the need for new ways of holding business accountable in the era of digital platforms like Facebook, Google and Amazon, which use algorithmic personalization to exert private control over the infrastructure of our societies.

Book The Role of Law and Ethics in the Globalized Economy

Download or read book The Role of Law and Ethics in the Globalized Economy written by Joseph Straus and published by Springer Science & Business Media. This book was released on 2009-04-21 with total page 178 pages. Available in PDF, EPUB and Kindle. Book excerpt: Preface International conferences are not organized overnight—especially not when high ranking personalities from politics, business and academia should be offered an adequate platform for addressing and discussing highly relevant contemporary issues. The conference on “The Role of Law and Ethics in the Globalized Economy,” which took place on May 22 and 23, 2008 in the Bavarian Academy of Sciences and Humanities in Munich, was no exception. When the first preparations started at the end of 2006, neither the subprime crises nor the general crises of the global financial system, whose shock waves have rocked the financial businesses in subsequent months, were known; nor were they predictable or even imaginable. Based on our monitoring of the globalization process and its apparent impact—not only on the economic and technological environment, but also on the social en- ronment—it was appropriate for the conference to begin by serving as a platform for analysing the status quo of the process of globalization, as relevant to politics, business and academia, and for exploring how the interest groups in those domains cope with the challenges of globalization. In the end, however, the purpose of the conference was to produce proposals for conditions for “upwards” global compe- tion, meaning that minimum conditions should be worked out to enable people to live and labour humanely. Such conditions would be those which should help avoid otherwise inevitable frictions in society, both nationally and internationally.

Book Law Capitalism

Download or read book Law Capitalism written by Curtis J. Milhaupt and published by University of Chicago Press. This book was released on 2008-09-15 with total page 281 pages. Available in PDF, EPUB and Kindle. Book excerpt: Recent high-profile corporate scandals—such as those involving Enron in the United States, Yukos in Russia, and Livedoor in Japan—demonstrate challenges to legal regulation of business practices in capitalist economies. Setting forth a new analytic framework for understanding these problems, Law and Capitalism examines such contemporary corporate governance crises in six countries, to shed light on the interaction of legal systems and economic change. This provocative book debunks the simplistic view of law’s instrumental function for financial market development and economic growth. Using comparative case studies that address the United States, China, Germany, Japan, Korea, and Russia, Curtis J. Milhaupt and Katharina Pistor argue that a disparate blend of legal and nonlegal mechanisms have supported economic growth around the world. Their groundbreaking findings show that law and markets evolve together in a “rolling relationship,” and legal systems, including those of the most successful economies, therefore differ significantly in their organizational characteristics. Innovative and insightful, Law and Capitalism will change the way lawyers, economists, policy makers, and business leaders think about legal regulation in an increasingly global market for capital and corporate governance.
