Apart from the procedure of constructing the principles of justice, there are no moral facts.' So wrote John Rawls in his highly influential 1980 Dewey lectures 'Kantian Constructivism in Moral Theory'. Since then there has been much discussion of constructivist understandings, Kantian or otherwise, both of morality and of reason more generally. Such understandings typically seek to characterize the truth conditions of propositions in their target domain in maximally metaphysically unassuming ways, frequently in terms of the outcome of certain procedures or the passing of certain tests, procedures or tests that speak to the distinctively practical concerns of deliberating human agents living together in societies. But controversy abounds over the interpretation and the scope as well as the credibility of such constructivist ideas. Book excerpt: Contemporary philosophical pluralism recognizes the inevitability and legitimacy of multiple ethical perspectives and values, making it difficult to isolate the higher-order principles on which to base a theory of justice. Rising up to meet this challenge, Rainer Forst, a leading member of the Frankfurt School's newest generation of philosophers, conceives of an "autonomous" construction of justice founded on what he calls the basic moral right to justification. Forst begins by identifying this right from the perspective of moral philosophy. Then, through an innovative, detailed critical analysis, he ties together the central components of social and political justice--freedom, democracy, equality, and toleration--and joins them to the right to justification. The resulting theory treats "justificatory power" as the central question of justice, and by adopting this approach, Forst argues, we can discursively work out, or "construct," principles of justice, especially with respect to transnational justice and human rights issues. As he builds his theory, Forst engages with the work of Anglo-American philosophers such as John Rawls, Ronald Dworkin, and Amartya Sen, and critical theorists such as Jürgen Habermas, Nancy Fraser, and Axel Honneth. She argues that in fact, Aristotle and Kant share a distinctive view about the locus of moral value and the nature of human choice that, among other things, gives them account of what it means to act rationally that is superior to other accounts. In Part III, Other Reflections, Korsgaard takes up question how we come to view one another as moral agents in Hume's philosophy. She examines the possible clash between the agency of the state and that of the individual that led to Kant's paradoxical views about revolution. And finally, she discusses her methodology in an account of what it means to be a constructivist moral philosopher. The first half describes the moral theory that Gentile explicitly identifies with actual idealism, according to which all thinking, rather than an exclusive domain of ‘practical reason', has a moral character. It is argued that after Gentile’s turn to Fascism in the early 1920s, this theory is increasingly conflated with his political doctrine. This entails several major changes that cannot be squared with the underlying metaphysics. The second half of the book develops a more plausible account of Gentilean moral constructivism based on the pre-Fascist idea of reasoning as an internal dialogue. Comparisons and contrasts are drawn with contemporary constructivist doctrines, as well as theories employing dialogical conceptions of reason. The internal dialogue is presented as a device enabling the thinking subject to make objective judgments about real-world problems despite the impossibility of her occupying a fully objective standpoint. Thus actual idealist moral theory is offered as an example of constructivism at its most radical, inviting advocates of less radical varieties to reassess the foundations on which their theories are built.
