Courts often cannot enforce their judgments and must rely on reputational sanctions to ensure compliance. One way to do this is for courts to improve their reputation for generating compliance with their judgments. When the court's reputation is increased, parties will be expected to comply with its judgments and the reputational sanction on a party that fails to comply will be higher. This strategy allows national and international courts, which cannot enforce their judgments against states and executives, to improve the likelihood that their judgments will be complied with over time. This book describes the judicial tactics that courts use to shape their judgments in ways that maximize their reputational gains.

The self-made Coornhert was a notary, secretary, artist, poet, playwright, translator, theologian, but most of all, he was an intrepid controversialist, "born to contradict", indefatigable in his critique of the public church and sects. His main concern in polemics and disputations was the defense of freedom of conscience and advocacy of toleration. Coornhert's individualism made him eschew any restrictions on personal religious choice. His tolerationist writings, especially Synod on the Freedom of Conscience (1582) and Trial of the Killing of Heretics(1590), were rooted in his spiritualist belief system. He found inspiration in other protagonists of religious freedom, such as Sebastian Franck and Castellio, but his ideas were uniquely Coornhertian. He possessed an unrelenting drive to combat constraint, and regarded himself as "God's battering ram, meant to break down the prison of men's conscience".

The fundamental challenge for interpreters of the Constitution is how to read that old document over time. In Fidelity & Constraint, legal scholar Lawrence Lessig explains that one of the most basic approaches to interpreting the constitution is the process of translation. Indeed, some of the most significant shifts in constitutional doctrine are products of the evolution of the translation process over time. In every new era, judges understand their translations as instances of "interpretive fidelity," framed within each new temporal context. Yet, as Lessig also argues, there is a repeatedly occurring countermove that upends the process of translation. Throughout American history, there has been a second fidelity in addition to interpretive fidelity: what Lessig calls "fidelity to role." In each of the cycles of translation that he describes, the role of the judge -- the ultimate translator -- has evolved too. Old ways of interpreting the text now become illegitimate because they do not match up with the judge's perceived role. And when that conflict occurs, the practice of judges within our tradition has been to follow the guidance of a fidelity to role. Ultimately, Lessig not only shows us how important the concept of translation is to constitutional interpretation, but also exposes the institutional limits on this practice. Book excerpt: In a model of pretrial bargaining under asymmetric information, we analyze the defendant's threat to proceed to trial in the face of a rejected offer. The incidence of trial is lower when the defendant's constraint is binding compared with the unconstrained case. The signs of some of the comparative statics of the model are a function of whether or not the defendant's credibility constraint is binding. In particular, fee shifting has no effect on the incidence of trial when the credibility constraint is not binding, but has an ambiguous effect when the constraint is binding. In this latter case, the use of fee shifting will lower the incidence of trial if and only if the plaintiff expects to shifts fees on net to the defendant.

The participants used the opportunity to meet experts from global optimi- tion, mathematical programming, constraint programming, and applications, and to present and discuss ongoing work and new directions in the ?eld. Four invited lectures and 20 contributed talks were presented at the workshop. The invited lectures were given by John Hooker (Logic-Based Methods for Global Optimization), Jean-Pierre Merlet (Usual and Unusual Applications of Interval Analysis), Hermann Schichl (The COCONUT Optimization Environment), and Jorge Mor ́ e (Global Optimization Computational Servers).
