Book excerpt: In the early summer of 2005, an international expert meeting was convened in The Hague to share and compare national experiences with conciliation and mediation as methods for resolving collective labor disputes. Both the European Union and the Council of Europe have committed themselves to promoting these methods which aim to assist disputants in finding creative, negotiated solutions, while preserving their long-standing relationships. Ideally, trade unions and employers (associations) have such long-standing relationships, and many European countries have specialized conciliation officers or mediation services operating in this area. The meeting allowed leading mediators and academics to share their experiences and to exchange their views on the changes permeating Europe today: the rise of transnational labor disputes, the decentralization of collective bargaining, the process of de-unification, the joining of the EU by new member states without a social dialogue tradition, and the insights generated by the emerging science of principled bargaining, facilitative mediation, and conflict management. All these developments are likely to increase the demand for expert mediation services assisting more often less experienced negotiators. Thereby, the very nature of mediation may gradually change. This book documents the proceedings and provides a comprehensive overview of EU initiatives in the field of collective labor law and dispute resolution.

Book excerpt: As unions in most other industrialized democracies continue to decline, unions in Spain have been able to regain and maintain strength despite unfavorable institutional, political, and economic conditions. The Politics of Industrial Relations provides a comprehensive analysis of Spanish unions from the Franco dictatorship until the present. It builds on industrial relations, comparative politics, and political economy literature to investigate the trajectory of Spanish unions. The book analyzes unions as political actors, that is, their interaction and involvement with governments, political parties, and nationwide policy-making processes to explain why Spanish unions appear in some ways as atypical in West European comparison. The development of Spanish unions and industrial relations is framed in a historical-institutionalist approach while also taking into account globalization and Europeanization processes. Using the case of the Spanish transition to democracy, the book demonstrates that the historical sequencing of institutional reforms in the political and industrial relations arenas holds significant and long-lasting consequences for the nature of unions and labor relations. The book concludes that by understanding unions as political actors, the history of Spanish unionism and industrial relations institutions is more easily accommodated than looking at unions as industrial actors alone. Comprehensive in its theoretical scope and empirical depth, The Politics of Industrial Relations presents Spain as an anomaly, and thus as a test case, for a multitude of theories developed in the political economy and industrial relations literatures.

Book excerpt: One of the first longitudinal studies of collective resistance in the developing world, Waves of Protest examines large-scale contentious action in El Salvador during critical eras in the country’s history. Providing a compelling analysis of the massive waves of protests from the early twentieth century to the present in El Salvador, Paul D. Almeida fully chronicles one of the largest and most successful campaigns against globalization and privatization in the Americas. Drawing on original protest data from newspapers and other archival sources, Almeida makes an impassioned argument that regime liberalization organizes civil society and, conversely, acts of state-sponsored repression radicalize society. He correlates the ebb and flow of protest waves to the changes in regime liberalization and subsequent de-democratization and back to liberalization. Almeida shows how institutional access and competitive elections create opportunity for civic organizations that become radicalized when authoritarianism increases, resulting at times in violent protest campaigns that escalate to revolutionary levels. In doing so, he brings negative political conditions and threats to the forefront as central forces driving social movement activity and popular contention in the developing world. Paul D.
