Book Admission to the United Nations

Download or read book Admission to the United Nations written by Thomas D. Grant and published by BRILL. This book was released on 2009-04-07 with total page 364 pages. Available in PDF, EPUB and Kindle. Book excerpt: The United Nations began as an alliance during World War II. Eventually, however, the UN came to approximate a universal organization - i.e., open to and aspiring to include all States. This presents a legal question, for Article 4 of the Charter contains substantive criteria to limit admission of States to the UN and no formal amendment has touched that part of the Charter. This book gives an up-to-date account of admission to the UN, from the 1950s ‘logjam’ through on-going controversies like Kosovo and Taiwan. With reference to Charter law, the book considers how Article 4 came to accommodate universality and what the future of a universal organization in a world of politically diverse States might be.

Book The Statute of the International Court of Justice

Download or read book The Statute of the International Court of Justice written by Andreas Zimmermann and published by OUP Oxford. This book was released on 2012-10-11 with total page 1798 pages. Available in PDF, EPUB and Kindle. Book excerpt: The International Court of Justice is the principal judicial organ of the United Nations and plays a central role in both the peaceful settlement of international disputes and the development of international law. This comprehensive Commentary on the Statute of the International Court of Justice, now in its second edition, analyses in detail not only the Statute of the Court itself but also the related provisions of the United Nations Charter as well as the relevant provisions of the Court's Rules of Procedure. Five years after the first edition was published, the second edition of the Commentary embraces current events before the International Court of Justice as well as before other courts and tribunals relevant for the interpretation and application of its Statute. The Commentary provides a comprehensive overview and analysis of all legal questions and issues the Court has had to address in the past and will have to address in the future. It illuminates the central issues of procedure and substance that the Court and counsel appearing before it face in their day-to-day work. In addition to commentary covering all of the articles of the Statute of the ICJ, plus the relevant articles of the Charter of the United Nations, the book includes three scene-setting chapters: Historical Introduction, General Principles of Procedural Law, and Discontinuation and Withdrawal. The second edition of the Commentary adds two important and instructive chapters on Counter-Claims and Evidentiary Issues. The combination of expert editors and commentators, and their assessment of new developments in the important work of the ICJ, make this a landmark publication in the field of international law.

Book The law of international organisations

Download or read book The law of international organisations written by Nigel White and published by Manchester University Press. This book was released on 2016-11-18 with total page 276 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book provides a concise account of the principles and norms of international law applicable to the main-type of international organisation - the inter-governmental organisation (IGO). That law consists of principles and rules found in the founding documents of IGOs along with applicable principles and rules of international law. The book also identifies and analyses the law produced by IGOs, applied by them and, occasionally, enforced by them. There is a concentration upon the United Nations, as the paradigmatic IGO, not only upon the UN organisation headquartered in New York, but on other IGOs in the UN system (the specialised agencies such as the World Health Organisation).

Download or read book The Power of Legality written by Nikolas M. Rajkovic and published by Cambridge University Press. This book was released on 2016-07-28 with total page 407 pages. Available in PDF, EPUB and Kindle. Book excerpt: From an airstrip in Saudi Arabia, the CIA launches drones to 'legally' kill Al-Qaida leaders in Yemen. On the North Pole, Russia plants a flag on the seabed to extend legal claim over resources. In Brussels, the European Commission unveils its Emissions Trading System, extending environmental jurisdiction globally over foreign airlines. And at Frankfurt Airport, a father returning from holiday is detained because his name appears on a security list. Today, legality commands substantial currency in world affairs, yet growing reference to international legality has not marked the end of strategic struggles in global affairs. Rather, it has shifted the field and manner of play for a plurality of actors who now use, influence and contest the way that law's rule is applied to address global problems. Drawing on a range of case studies, this volume explores the various meanings and implications of legality across scholarly, institutional and policy settings.

Available in PDF, EPUB and Kindle. Book excerpt: The sixth edition of Public International Law continues the book’s accessible, student-friendly tradition with a writing style that is both conversational and easy to read. Uniquely both a textbook and a casebook, the facts of each case and the details of decisions are succinctly set out, followed by detailed commentary and, where appropriate, a brief explanation of subsequent events. Fully up to date with all recent developments, the sixth edition covers the major areas of public international law and examines the leading cases of the International Court of Justice and other international courts and tribunals, whilst paying attention to judgments of national courts, including the UK Supreme Court, the US Supreme Court, and courts of many other countries when they make challenging or novel contributions to international law. Features designed to support learning include highlighted key cases, introductory chapter overviews and concise outlines, and recommended further reading. New to this edition are study boxes which apply public international law to recent events and examine controversial legal issues in a constructive way, including the ongoing armed conflict between Russia and Ukraine, the murder of Jamal Khashoggi, and the judicial battle of Julian Assange. Diagrammatic aides-mémoires at the end of each chapter have also been updated to further summarise topics covered in that chapter. This book is an ideal learning tool for students of law or political science, practitioners, and legal advisors and provides a clear and straightforward overview for anyone with an interest in international law.
