Book excerpt: The Social Security Board of Trustees projects that the Social Security Disability Insurance (SSDI) trust fund, which provides benefits to individuals who cannot work due to a medical condition that is expected to last at least 1 year or result in death, will be exhausted in 2016 and notes that changes designed to improve the financial status of the SSDI program are needed soon. This report examined other federal benefit programs that could be overlapping with disability programs administered by the Social Security Admin. (SSA). Current law allows individuals to receive concurrent military retirement benefits from 3 sources: the Dept. of Defense (DOD), Dept. of Veterans Affairs (VA) disability compensation, and SSDI. This report identifies the number of disabled military personnel who received concurrent benefit payments from DOD retirement, VA disability compensation, and SSDI during FY 2013. Out of the 1.9 million DOD nondisability and disability retirees, this report identified 59,251 individuals who received concurrent payments in FY 2013 from DOD retirement, VA disability compensation, and SSDI. Book excerpt: 21st Century System for Evaluating Veterans' Disability Benefits recommends improvements in the medical evaluation and rating of veterans for the benefits provided by the Department of Veterans Affairs (VA) to compensate for illnesses or injuries incurred in or aggravated by military service. Compensation is a monthly cash benefit based on a rating schedule that determines the degree of disability on a scale of 0 to 100. Although a disability rating may also entitle a veteran to ancillary services, such as vocational rehabilitation and employment services, the rating schedule is out of date medically and contains ambiguous criteria and obsolete conditions and language. The current rating schedule emphasizes impairment and limitations or loss of specific body structures and functions which may not predict disability well. 21st Century System for Evaluating Veterans' Disability Benefits recommends that this schedule could be revised to include modern concepts of disability including work disability, nonwork disability, and quality of life. In addition to the need for an updated rating schedule, this book highlights the need for the Department of Veterans' Affairs to devote additional resources to systematic analysis of how well it is providing services or how much the lives of veterans are being improved, as well as the need for a program of research oriented toward understanding and improving the effectiveness of its benefits programs.

Book excerpt: This study analyzes the influence of pre-service experiences and initial military job match on military attrition of first-term enlisted males during their first six months of service (early attrition). The dynamics of attrition behavior are examined in terms of recent firm-specific human capital and job matching models. The determinants of early attrition are compared across services and with those of civilian job separations of young workers. Some of the conclusions drawn are: enlistees with a history of frequency civilian job changes or a recent spell of unemployment are attrition-prone; aspects of the initial military occupational assignment like individual suitability and satisfaction do not significantly influence early attrition; the early attrition rate of nonhigh-school graduates is nearly twice that of graduates even after controlling for previous work experiences, aptitude, and other variables that influence attrition; and older recruits are more attrition-prone than younger recruits.

Book excerpt: In 1981, the Supreme Court ruled that the former spouse of a military member or retiree could not be awarded any share of that member's/retiree's retired pay as a part of a divorce property settlement in a community property state. In response, Congress enacted the Uniformed Services Former Spouses' Protection Act (USFSPA) in 1982. Under the USFSPA, as amended, state courts can treat disposable military retired pay as divisible property in divorce cases. However, state laws may vary on these concepts. The USFSPA makes no assumption of such a division nor does it presume how much of a division should be made. In addition to possible receipt of retired pay, certain former spouses remain eligible to receive certain military benefits or privileges. Recent changes in other laws that affect the concurrent receipt of military retired pay and veteran disability pay may affect the amount of retired pay a former spouse receives. In other situations, later career and financial decisions made by military retirees may affect the availability of their retired pay. For example, military retirees who take federal civilian jobs and then retire from those jobs can waive their military retired pay and credit their military time to their civilian careers. In so doing, they eliminate their military retired pay, and thereby any share that might have been awarded to the former spouse. Since its inception, the USFSPA has remained contentious. Opponents of the law feel that it is unfair to servicemembers and should be modified or repealed. Proponents argue that the law protects the former spouse within nationally accepted standards. Some of the most frequently cited issues include (1) definition of disposable retired pay, (2) effects from new laws concerning concurrent receipt of military retired pay and veteran disability compensation, (3) interactions with other federal retirement systems, (4) effects in cases of early separation of servicemembers, and (5) treatment of benefits upon remarriage of a former spouse. As with the original provisions of the USFSPA, these and other proposed changes have been the source of great debate. Although legislation making various changes to the USFSPA has been introduced in the past, none of this legislation has allowed for retroactive change to settled cases.
