Download or read book Collective Dominance and Collusion written by Marilena Filippelli and published by Edward Elgar Publishing. This book was released on 2013-01-01 with total page 363 pages. Available in PDF, EPUB and Kindle. Book excerpt: By examining the issue of collusion in EU and US competition law, this book suggests possible strategies for improving the antitrust enforcement against parallelism, by exploiting the most advanced achievements of economic analysis. The book contains a suggested approach to collusion, in ex ante and ex post perspectives. By moving from the analysis of the state of art, in terms of law, case law, and scholarship, Marilena Filippelli analyses inconsistencies and failures in the current antitrust enforcement toward collusion and develops a workable parameter for the issue of collective dominance. The most innovative part of this work goes beyond the analysis itself of collective dominance and involves the interference of arts. 101 and 102. The conclusion is a re-definition of the relationship between those rulesÑfrom dichotomy to redundancy. Finally, the book highlights the antitrust significance of semi-collusion, as a strategy made of collusion and competition. The author considers economic models equaling, as for the effects, collusion and semi-collusion and the case law supporting the qualification of semi-collusion as a species of collusion. The analysis involves both US and EU systems, under the highly topical economic-oriented approach. It also contains an original view of European antitrust prohibitions. Because of its contents and its approach, this book will be attractive to every academic interested in antitrust law. Moreover, the well-documented research on parallelism, involving law, case law and scholarship, makes this book interesting also for competition authorities and antitrust lawyers.

Book excerpt: . . . this collection should be viewed as a pioneering effort. . . this book would most likely serve as a useful quick reference source for students of industrial economics. It can also serve as a valuable point of departure for those who wish to study intellectual developments in a major field in more detail. John Howard Brown, Journal of the History of Economic Thought This work will be indispensable for anyone who undertakes serious scholarly research in industrial organization. With its knowledgeable authors and editors, this book offers us valuable materials, about the work of writers long forgotten and others inadequately recognized, that can contribute much to understanding in the field. William J. Baumol, New York University and Princeton University, US This encyclopaedic work celebrates the scores of leading pioneers who created the modern economic field of industrial organization, at the heart of which lie competition and monopoly, the two great forces that drive modern markets. Their pioneering work has shaped the field s growing research as well as the past, present and future debates in Europe and America over several centuries. This landmark book includes authoritative entries on all the major figures in both Europe and North America. Pioneers of Industrial Organization also reveals how public policies such as antitrust and regulation and deregulation since the 1970s can promote, or impede economic results and progress. Readers will find the intellectual pioneers, the theories and policies, and the debates, in all their variety herein. Some pioneers have been free-market advocates, others have been more protective of popular values, but all have strained to make the economic engine promote more wealth, progress and fairness. This book presents the people, ideas and debates with careful neutrality, and also with clear, concise writing. For all those interested in modern economic progress and its problems, this book provides deep insight as well as great personal colour. It will be an essential source of reference for students, researchers and professors of economics, as well as those concerned with the historical foundations or the conceptual and thematic developments in industrial organization.
Download or read book Mainstreams in Industrial Organization written by H.W. de Jong and published by Springer Science & Business Media. This book was released on 2013-06-29 with total page 461 pages. Available in PDF, EPUB and Kindle. Book excerpt: The present two volumes contain the essays and part of the discussions as presented at the conference on Mainstreams in Industrial Organiza tion, held at the University of Amsterdam, 21-23 August 1985. The thema was chosen because the field of studies commonly designated "industrial organization" in the Anglo-Saxon countries, or "market theory" in Continental Europe, has experienced important alterations during the past decade. Partly this reflects changing theoretical views inside the field, in which shifts in the core concepts have occurred and different emphasis is laid on time-honoured views and results. Partly, critical views have been voiced from outside the field. As in all open scientific debate, they have to be weighed and, if necessary, taken into account. Partly also, diver gent developments in thinking between the Anglo-Saxon, European and Japanese areas need to be considered, because both the problems and the ways of approaching them still differ. The variety of views, theori~s and results is testimony to the vitality of this field of economics; variety is generated by the creative endeavours, from which the chaff is being beaten out by critical discussions. That is especially true for the concept of competition itself, which industrial organization economists are debating intensively.

The last part is devoted to a more general view on the structural adjustment dynamics of innovative milieu, raising useful questions of strategy and policy.

Download or read book The Economic Importance of Intangible Assets written by Patrizio Bianchi and published by Routledge. This book was released on 2017-11-30 with total page 298 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is the result of a two-year interdisciplinary research programme named PRISM (Policy making, Reporting and measuring, Intangibles, Skills development and Management), financed by the European Commission and aimed both at understanding better how these assets are created and developed and what the policy implications of their growing importance in economies are. The book focuses on the policy issues raised by the increasing importance of intangible assets in a country's growth and competitiveness. The main idea is that the value of intangible assets, which is imperfectly captured by current economic indicators and imperfectly formalized in economic theory, lies in their being the cumulative elements that keep the economy together - the glue of the system. This argument leads to the focus on networks and social capital as drivers of the development of intangible assets and is illustrated by the case of EU innovation and knowledge diffusion policy.

Download or read book Antitrust between EU law and national law Antitrust fra diritto nazionale e diritto dell Unione Europea written by Enrico Adriano Raffaelli and published by Primento. This book was released on 2013-02-22 with total page 522 pages. Available in PDF, EPUB and Kindle. Book excerpt: This work contains the papers of the Tenth Conference on “Antitrust between EU Law and national law”, held in Treviso on May 17 and 18 , 2012 under the patronage of the European Lawyers Union – Union des Avocats Européens (UAE), the Associazione Italiana per la Tutela della Concorrenza - the Italian section of the Ligue Internationale du Droit de la Concurrence (LIDC)-, the Associazione Italiana Giuristi di Impresa (AIGI), the European Company Lawyers Association (ECLA), and the Associazione Antitrust Italiana (AAI). Some of the papers have been extensively reviewed and updated by the authors prior to publication. Contributions contained in this volume are the result of an in-depth analysis and study of the most salient issues arising from the application of antitrust rules, carried out by experienced and high-ranking professionals, company lawyers, academics and EU/national institutional representatives who attended the Conference. They deal with extremely topical issues, lying at the heart of current antitrust debate. Some of the most contemporary topics include those relative to the large-scale distribution sector and the control of concentrations at both national and European level. Ample consideration is also given to salient antitrust issues encountered in undertakings’ day-to-day business life, as well as to the future of antitrust in the global economy, also in the light of the new powers recently attributed to the Italian Antitrust Authority to challenge administrative acts. This volume also includes some precious insights on the assessment and quantification of damages in antitrust infringements, from both an economic and legal perspective, as well as reflections on the role of judges in the application of antitrust law, also following the principles set forth by the European Court of Human Rights in the well-known Menarini case.
