Book excerpt: Au Canada, il n'existe dans la Constitution aucune disposition relative à la compé-tence en matière de langue. Dans un arrêt rendu en 1988, la Cour suprême du Canada a affirmé que : La langue n'est pas une matière législative indépendante, elle est "accessoire" à l'exercice de la compétence relative à une catégorie de sujets attribuée au Parlement ou aux assemblées législatives provinciales par la Loi constitutionnelle de 1867. Ainsi, le pouvoir de légiférer dans le domaine linguistique appartient aux deux ordres de gouvernement, selon les compétences législatives qui leur sont attribuées. La première Loi sur les langues officielles (LLO) a été adoptée par le gouvernement fédéral en juillet 1969, à la suite des travaux de la Commission royale d'enquête sur le bilinguisme et le biculturalisme. En 1982, l'enchâssement des droits linguistiques dans la Constitution a ouvert une nouvelle page de l'évolution dans ce domaine. La LLO a été révisée en septembre 1988, afin de tenir compte du nouvel ordre constitu-tionnel. Cette révision a eu pour effet d'élargir le fondement législatif des politiques et des programmes linguistiques adoptés par le gouvernement fédéral. La LLO a été de nouveau modifiée en novembre 2005 afin de clarifier l'obligation qu'ont les institutions fédérales d'agir en faveur du développement des communautés minoritaires de langue officielle et de la promotion de la dualité linguistique.
