Available in PDF, EPUB and Kindle. Book excerpt: Derived from the renowned multi-volume International Encyclopaedia of Laws, this practical analysis of competition law and its interpretation in Moldova covers every aspect of the subject – the various forms of restrictive agreements and abuse of dominance prohibited by law and the rules on merger control; tests of illegality; filing obligations; administrative investigation and enforcement procedures; civil remedies and criminal penalties; and raising challenges to administrative decisions. Lawyers who handle transnational commercial transactions will appreciate the explanation of fundamental differences in procedure from one legal system to another, as well as the international aspects of competition law. Throughout the book, the treatment emphasizes enforcement, with relevant cases analysed where appropriate. An informative introductory chapter provides detailed information on the economic, legal, and historical background, including national and international sources, scope of application, an overview of substantive provisions and main notions, and a comprehensive description of the enforcement system including private enforcement. The book proceeds to a detailed analysis of substantive prohibitions, including cartels and other horizontal agreements, vertical restraints, the various types of abusive conduct by the dominant firms and the appraisal of concentrations, and then goes on to the administrative enforcement of competition law, with a focus on the antitrust authorities’ powers of investigation and the right of defence of suspected companies. This part also covers voluntary merger notifications and clearance decisions, as well as a description of the judicial review of administrative decisions. Its succinct yet scholarly nature, as well as the practical quality of the information it provides, make this book a valuable time-saving tool for business and legal professionals alike. Lawyers representing parties with interests in Moldova will welcome this very useful guide, and academics and researchers will appreciate its value in the study of international and comparative competition law.

Book New Competition Law of the Republic of Moldova

Download or read book New Competition Law of the Republic of Moldova written by Alexandr Svetlicinii and published by . This book was released on 2014 with total page 9 pages. Available in PDF, EPUB and Kindle. Book excerpt: The summary analysis of the major substantive and procedural provisions of the new competition law demonstrates that Moldovan Competition Act (MCA) is generally in compliance with the relevant EU competition rules and principles, as it corresponds to community legislation, regulations, guidelines, case law and best practices. Moreover, the MCA contains some of the most advanced legal constructs, such as those discussed and adopted in the ECN working groups. The specifics of the Moldovan legal system and the involvement of the EU experts in the process of drafting the new competition law have resulted in a very thorough and detailed legislation, both on the matters of substance and procedure. While it provides a high degree of clarity and legal certainty to those affected by its enforcement, the MCA appears to be very demanding as far as technical and institutional capacities of the CC are concerned. Both the qualitative (complex economic assessment, detailed regulation of the applicable economic tests, etc.) and quantitative (the amount of tasks and procedural steps in exercising investigative and sanctioning powers, combination of the enforcement of antitrust, merger control and unfair competition rules in a single authority) aspects of the competition law enforcement under the new legislative framework will present a significant challenge to the newly established Competition Council (CC). It remains to be seen whether the CC's human, financial, technical and administrative resources would lead to a coherent and effective enforcement of competition rules in Moldova.

Book Global Food Value Chains and Competition Law

Download or read book Global Food Value Chains and Competition Law written by Ioannis Lianos and published by Cambridge University Press. This book was released on 2022-05-05 with total page 661 pages. Available in PDF, EPUB and Kindle. Book excerpt: The food industry is a notoriously complex economic sector that has not received the attention it deserves within legal scholarship. Production and distribution of food is complex because of its polycentric character (as it operates at the intersection of different public policies) and its dynamic evolution and transformation in the last few decades (from technological and governance perspectives). This volume introduces the global value chain approach as a useful way to analyse competition law and applies it to the operations of food chains and the challenges of their regulation. Together, the chapters not only provide a comprehensive mapping of a vast comparative field, but also shed light on the intricacies of the various policies and legal fields in operation. The book offers a conceptual and theoretical framework for competition authorities, companies and academics, and fills a massive gap in the competition policy literature dealing with global value chains and food.

Book The International Dimension of EU Competition Law and Policy

Download or read book The International Dimension of EU Competition Law and Policy written by Anestis S. Papadopoulos and published by Cambridge University Press. This book was released on 2010-10-28 with total page pages. Available in PDF, EPUB and Kindle. Book excerpt: Modern competition law was first employed by countries over one hundred years ago in order to address issues relating to restrictions of trade at the national level. Recent international economic integration has weakened the distinction between the domestic and the international in several fields of economic activity, and consequently the laws which regulate such activity, competition law included. Several attempts to address the paradox of adopting national competition rules to address international issues have been made at the international, regional and (lately) bilateral levels. This book discusses the international dimension of EU competition law, and examines the position taken by the EU in four distinct categories of international agreements which are devoted to competition or include competition provisions. In particular, it analyses the EU's position with regard to bilateral enforcement cooperation agreements, bilateral free trade agreements, plurilateral-regional agreements and the long negotiations for the adoption of a multilateral competition regime.

Book Abuse of Dominant Position and Globalization Protection and Disclosure of Trade Secrets and Know How

Download or read book Abuse of Dominant Position and Globalization Protection and Disclosure of Trade Secrets and Know How written by Pranvera Këllezi and published by Springer. This book was released on 2017-05-05 with total page 637 pages. Available in PDF, EPUB and Kindle. Book excerpt: This publication provides an unparalleled comparative analysis of two "hot topics" in the field of antitrust and unfair competition law with regard to a number of key countries. The first part of the book examines the prohibition of abuse of a dominant position and globalization in relation to two broad questions: first, whether there is consistency between the approaches of different jurisdictions to the notion of abuse, and, second, whether there are too many restrictions on legal rights and business opportunities resulting from the prohibition of abuse of dominance. The international report drafted by Professor Pinar Akman reveals that there are as many similarities as differences between the approaches of the twenty-one jurisdictions studied and presented in this book. This is an invitation to read the excellent international report as well as the reports on specific jurisdictions in order to grasp the variety of arguments and approaches of this antitrust area, which may, on the surface, appear alike. The second part gathers contributions on the question of protection and disclosure of trade secrets and know-how from various jurisdictions. The need for adequate protection of trade secrets has increased due to digitalization and the ease with which large volumes of misappropriated information can be reproduced. The comprehensive international report, prepared by Henrik Bengtsson, brings together these reflections by comparing various national positions. The book also discusses the resolutions passed by the General Assembly of the International League of Competition Law (LIDC) following a debate on each of these topics, and includes proposed solutions and recommendations.
